What would you do?

Just found out today that the ex-employee of mine who broke into my business a couple months after being fired and stole $30,000+ in cash and equipment who was arrested had the case against him dropped.

I called the prosecutor - and asked him why? He told me a lack of evidence. They had fingerprints and a matching footprint from him as well as motive, opportunity, time that it happened, and he skipped out of interviews with the police on the crime 3-4X stretching it out over 4 months before they even interrogated him.
I asked the prosecutor why when I called the police 4X (yes 4X)to tell them the crook confessed to 4 people about doing it that the police never followed up and the file had no information on that. But he's scott -free now (to use a pun).

I don't even know what to feel.

I soooooo fucking sick of being robbed.

it's not my case - it's criminal, handled by the gov't.

without a conviction it's very difficult for me to even sue him for it, and having dropped the case makes it near impossible to sue him as he can be scene as innocent of it.

with a conviction - even without jail time just a criminal record for it the civil case would be a slam dunk.

And I was arrested for unpaid parking tickets a few years ago. Pisses you off doesn't it.

did you watch the OJ trial? No need for conviction... but suing civilly would like cost at least 15k. Seriously, hire a guy who takes care of situations for a couple K

After Shock Media 11-02-2009 08:51 PM

You can still sue him and the level of guilt is typically much lower.

I have had that same thing happen to me in my hobby shop. Fuck I even found half my shit in the guys room that he stole, still with my price tags on it. His room mate let me know and I went and took some pics and video. Gave it to the cops and they got the stuff. Ended up dropping the case, again major evidence. Then to top it off - they gave the shit back to him.

damn that sucks. i feel your pain about loosing $$, f-ing sucks especially when there is nothing you can do.

not sure how courts are in Canada, but can you take to him a civil court? if you can get people in as a confession it might help

small claims is $35 but limited to $10,000 max recovery here - after legal fees it's a better way to go.

bankrupt - the SOB was probably the main reason I went bankrupt. Can't sue as it was against the corp and I can't legally own a corp till I'm out of bankruptcy.

CunningStunt 11-02-2009 09:19 PM

That's absolutely fucked Sleazy, I feel for you. Time to have the guy's legs broken.

grab your kahunas and get 'er done already... don't let people steal from you or they will do it again

I do not blame the cops. I blame the DA and ADA. The cops pretty much did their job in my case. Well I did do parts for them as anyone in a crime never feels they are moving fast enough, especially when you have a gut feeling you know who it was.
