The new legislation does offer an exception for when a cookie is “strictly necessary” — for example, if a user is shopping online, a cookie can go from a product page to the checkout page without the need for consent. |

Cookies, small programs that can be used to track Web movements, have come under fire as consumer groups, including the Federal Trade Commission, have sought to regulate companies that engage in targeted behavioral advertising..... (That is a piece of text from the above blog url) Seems it's already approved and will become effective within 18 months as a part of a bigger plan to regulate the EU web and draft new telecom laws also. |

Total madness! Are the EU Council complete idiots? Scary...

I agree this is stupid beyond stupid...
But if shopping carts are allowed, then things like our Linking Codes that set cookies would be allowed. Affiliate program cookies don't track peoples web movements, they track information related to the sale. I assume this is like Google Analytics and other real tracking tools. Which really, don't need to set cookies to do what they do. |
United States New Law: Changes Affect Testimonial Advertisements, Bloggers, Celebrity Endorsements
http://www.ftc.gov/opa/2009/10/endortest.shtm Under the revised Guides, advertisements that feature a consumer and convey his or her experience with a product or service as typical when that is not the case will be required to clearly disclose the results that consumers can generally expect. The revised Guides also add new examples to illustrate the long standing principle that “material connections” (sometimes payments or free products) between advertisers and endorsers – connections that consumers would not expect – must be disclosed. The revised Guides specify that while decisions will be reached on a case-by-case basis, the post of a blogger who receives cash or in-kind payment to review a product is considered an endorsement. |
