2257 Requirements on Adult Social Network & Dating Sites?
Can some one please tell me what the laws are in regards to Adult Social Networking & Dating sites?
I've seen a few things online on how adult sites in this type of venue are considered differently from the average pay site. Do members have posting limitations on what they're allowed to display on their profiles? Like - crotch shots - couples going at it - masterbation scenes etc... They Don't have to provide documentation and ID for their pics and videos- do they? From what I've seen on these kinds of adult sites, they have your basic 2257 statement, followed by a line which states that members are monitored in this manner and such... Does anyone have any more information on this? Thnx |
There's no guaranty that social networking sites do not need to be compliant with 2257. There is some language in the new regs that seem to indicate that a true social networking site -- Myspace, Twitter and Facebook will get a pass on 2257. Just like mainstream production companies get a pass in some ways.
I would be careful in allowing user generated content that is not being monitored. Not only from a 2257 perspective but you are now forced to allow copyright infringement. If you monitor for copyright infringement and remove content for DMCA violations you then have to monitor it for obscene/CP content and then you get into the 2257 mix and may not qualify as a social networking site. This is a very fine line in my opinion. |
I know what you mean, and of course I'll keeping and eye out for copyrighted material.
Members are only allowed to post their OWN personal images. I'm also wondering and perhaps you could tell me- what are the limitations on personal consent to use media between 2 parties? And by that I simply mean: If a guy and a girl shoot some clips and pics together and agree that they can BOTH use it online, verbally, can one of the 2 parties back the agreed upon consent to use it later on? I'm having this issue with a BF of mine who shot some great bondage pix of me, they've become kinda a signature shot for me & now he wants to say that I can't use them online, in adult community networks? Obvioulsy I can't SELL them, I don't have the docs required, but am I forced to take them down on my CUMunity venue, just because he said so after we broke up? You are going to need a lawyer now. You are getting into some really indepth IP issues than cannot be addressed in a forum.
The question you asked doesnt give enough facts for anyone to answer it. That alone could be a 30 minute discussion. You arent even seeing the difference between posting images and selling them -- they are one in the same. And how do you know that the person posting pics is only posting pics of themselves ? Seriously get an IP lawyer on board before you put yourself into a hole. It worth the money to get all your questions together and do a consult for a couple of hours. |

I really don't wanna spend a lot of money at this point- so maybe I'll sensor my ass off and take my own un documented stuff for the time being? Thnx for your help on this one though, I kinda knew there wasn't gonna be an easy solution here |
