Teacher/Student sex ok in Georgia if 16 or older.
 

ATLANTA -- A Cobb County judge has ruled that a former Marietta High teacher is not guilty of sexual assault charges from his affair with a 17-year-old student.

The Atlanta Journal-Constitution reports Thursday that Judge Robert Flournoy bypassed the jury and issued a directed verdict against 36-year-old Christopher King.

Flournoy said Wednesday the teacher-student relationship was gross and awful, but not illegal because it was consensual.

The Georgia Supreme Court ruled in June that when the student is a willing participant and is 16 or older, their consent can be a defense for teachers facing a sexual assault charge.

The judge referenced that decision in his ruling but said he has a feeling the Legislature is going to amend that law.

The girl testified Wednesday that she never felt intimidated or coerced by King.

Well it's hard to disagree with the fact that he said it because they were teacher-student.

But I still dont think the judge would have said anything if not for the girls age. I think it's the tired old thing where you have to put a public face on your comments, because people dont swallow common sense as readily as drama.

Maybe if we just pretend it was 5yrs+ on their ages.. now it's not gross and awful, it's simply a matter of the law being applied.

The whole point of statutory rape is that someone is unable to consent, presumable because they're not able to understand just what they're consenting to. With most 16 and 17 year olds, however, that's an obvious absurdity - they're likely to know all about sex, and if they consent, chances are that they know what they're doing.

It changes when there's pressure involved, of course. But when I look back on being 16/17... there were a bunch of female teachers I'd have fucked without a second thought, if given the chance.

100% correct... grounds for termination for sure, but no criminal act -- unless there's a specific law (which exists in some jurisdictions) which raises the age of consent when the older partner is in a "position of authority," which it appears that Georgia doesn't have.

Well of course it's not based on her age. There's almost no states with statutory rape or age of consent laws which would have mattered in this case.

It's pure and simple the fact he was a "person of trust" and/or "authoritative figure". Which most states have worded into their age of consent laws.

Actually in my state anyone that has sex with a 16 or 17 year old that is 4 years or older than them can be charged with statutory rape whether the 16/17 year old consented or not.

Florida is the same way except that its 16/17 with no one 7 years older than the consenting party under 18.

Isn't California straight 18 and up for even consensual sex?
