Pink Visual Files $6.75M Suit Against Brazzers

"NEW YORK — Pink Visual’s holding company has filed suit against the owners of Brazzers, alleging that four company-owned tube sites poached content from 45 copyrighted movies and have streamed them “tens of millions of times.”

he websites at issue in Pink Visual’s $6.75 million complaint include KeezMovies.com, PornHub.com, Extremetube.com and Tube8.com, all owned by Canadian companies Mansef Inc. and Interhub, whose officers operate both companies. "

Wow. Impressive lawyers ;)

When you don't comply... it becomes vastly different.

That should be a sign as to how tough it is... it isn't as easy and cheap as 'we' like to think things like this are.

This truly the time to celebrate... if it was $1 or $10 billion, this is exactly what our Industry has been begging for and TopBucks and crew just stood up and took that fight on!

Oh, and don't forget... Brazzers Parent Fighting $6.4 Million Forfeiture Suit - Source Xbiz it's coming from all sides!

SomeCreep 02-16-2010 12:10 PM

That case is going to drag out a while. In the end, both companies will settle. The lawyers will make out like bandits.

Roald 02-16-2010 12:26 PM

Lets see how this works out. I predict a settlement.

CIVMatt 02-16-2010 12:27 PM

Yeah congrats to the lawyers

fris 02-16-2010 12:34 PM

this should be interesting

Semi-Retired-Dave 02-16-2010 12:34 PM

It was all a matter of time. Hope they all go down one by one and someone puts a new law in place and we can go back to making money like it's 1999.

Nothing wrong with a tube when done properly

Finally some great news! Finally the war on tubes has began, finally using well thought and plausible legal theory (not some obscure "loss leader" etc charges which were tried before).

Topbucks you have our full support on this. If there's anything other producers can help you, just let us know. I'm pretty sure many other affected companies/individual producers will be willing to support your cause and your fight which is very important to all of us, to all of our industry.

Fat Panda 02-16-2010 12:38 PM

I hope these lawyers cover Brazzers in so much fucking paper work it will take then decades to crawl out!

The illegal tube came first, it takes time for the tide to shift and YouPorn is legal.

highly successfull as in traffic numbers like the "iligal" ones nope not really. But that doens;t take away the fact that there is nothing wrong with the tube model itself ;)

adapt or die.

MaDalton 02-16-2010 12:50 PM

2 lawsuits for a total of 13 million in one week - that must hurt a little

lazycash 02-16-2010 12:54 PM

Maybe Brazzers can get the US government to hand over the 6.5 million to Pink Visual they are holding.

Mutt 02-16-2010 12:54 PM

i salute TopBucks - about time somebody with deep pockets went after these thieves and they are going to win and win big. This ain't Viacom vs YouTube - we all know how the tube sites are run in porn, they won't be able to hide behind the DMCA, I'm sure that law firm will find plenty of evidence that blows them out of the water.

I just hope TopBucks sees the case through trial and doesn't take a settlement.

Direct download forums and blogs are worse than tubes. Unfortunately I do think that Rapidshare is set up in such a way that there is no legal case against them.

I'll tell our lawyers to get in touch with you since we're going after several tube sites in European courts. Won't say anything else on a public board, but I'm sure we'll be able to exchange ideas or join efforts.

Either way, it was about time for someone to do something :)

There is nothing wrong with any business model, as long as it complies with competition law and copyright law.

MaDalton 02-16-2010 01:20 PM

it is an open secret that bogus user profiles are created inhouse and content is uploaded through them. but i doubt that something that was said after 5 beer at a bar is usable at any court

Excellent news too. European tubes must be an even easier target than those US based since there's no DMCA in Europe, so good luck hunting.

Bman 02-16-2010 01:31 PM

no, but log files do and trying to explain why you have no log files to a judge doesnt help out your fight... :2 cents:

plus like i stated over a year ago, if these companies can pay people to sift through uploaded content and shitcan files with watermarks then they can surely check for pirated content..

Klen 02-16-2010 01:38 PM

Hope this will work without any settlement.
Also about DMCA thing-that thing about "if they remove content when requested, they are not guilty"does'nt have much sense beacuse when you notice your content on sites and send request to remove it can be viewed million times.
Also, does anyone remember case RIAA versus napster?
I mean it's basicly same shit but little different delivery type, they managed to force napster to filter all ilegall content and to show only legal files.

So what someone should do,is to force biggest tube sites to either remove upload function,or filter all content which doesnt have proper documentation, same as they did with napster and mininova.
Also, there is absolutely no need to steal content, after all they earn enough money to buy shitload of content or even to produce exclusive content for tube site.
And so far biggest legal tube is 4tube.com,not youporn.com which still accept uploads and i see docs requiments only for Usa public.

Dirty D 02-16-2010 01:58 PM

Mad respect for Top Bucks and Titan Media stepping up to legally prosecute theft by certain tube sites.
