SAN JOSE, Calif. ? RedTube attorneys asked a federal judge today to allow them to start serving subpoenas on those thought to be responsible or have knowledge in the redirection of RedTube traffic on July 24.

Sadly, I can see how RedTube might actually win this case. DMCA protects them from liability for the stolen scenes they post. While I applaud the efforts of whomever did the hacking, that is clearly illegal and the stolen content on the site won't even be brought up in arguments. It's irrelevant to the case.

My guess is that whomever did the hacking doesn't have any money anyway. So RT is probably just trying to warn others with the same ideas. I don't think they have much expectation of actually collecting any damages.

Actually it's quite relevant. If they seek damages on specific profit "loss" from the usage of stolen content, then they also have to admit the hackers were right about their motives :)
