Just out of curiosity, a question about the Dirty D case, regarding the underage girl
Aside from his case and what everyone thinks of him etc, I'd like to know: What consequences if any is the girl who was underage at the time this all went down and used fake ID to do underage porn going to face?
Should she face any consequences? No one seems to be talking about this part of the pictures. I'm not trying to take any blame away from the pornographers who aren't diligent enough to weed such girls out, especially the ones that at some point find out the girl's true age and still go ahead with the shoot (or shoots). But whether the photog/pornographer in this case knew or not, it is definitely a fact that the girl herself knew full well how old she was and still went ahead and took part in producing underage porn. "knowingly" and "willfully" are words the cops love to use on criminal warrants. Certainly someone who knows they are underage and willfully fakes an ID in order to do porn deserves some share of the punishment, no? I haven't read every post of every thread on Dirty D so pardon me if someone has already touched on this, but if they have I have yet to see it. Thoughts? |
Probably a slap on the wrist in comparison to what D faces :2 cents:

pointless to punish an underage girl for what is in essence exploiting herself - two underage girls in Rhode Island a couple years ago who on their own made sex videos of themselves and they got out amongst their school friends were charged with child pornography - ridiculous. Stickam is filled with child pornography, shot by kids themselves.
DirtyD is a scumbag, i don't think it's hard to see how grimey the world he inhabits is BUT if it's a case of a girl presenting him and his shooter with ID's that a reasonable person would look at and believe them to be authentic then I feel for the guy and hope the case collapses on the cops quickly. |
She will be the State's witness. You can be sure part of the deal is her walking. Probation, maybe?

reality is they aren't going to be punishing the child.

I can see why the GILF niche all of a sudden becomes more and more attractive to promote.

Nothing will ever happen to a girl that lies about her age. She is a minor and legally not responsible for herself.
There simply isn't any laws on the books that cover such matters, either in Florida or on the Federal level. However, that is the "criminal side" of the matter. If such an allegation came up there would be a claim against her parents. A photographer could sue the parents for not controlling their kid, etc... much like what happens often when kids under 18 cause a car wreck, etc. There would be a claim there -- but its not likely to happen. That would be a lawsuit / civil action, not against her but against the parents. No jail time at risk, just a lawsuit for money. |

She will be treated as a victim and nothing will happen to her.

If you read deeper....she was an (MARRIED) emancipated minor by the State of Florida. She fogot that she was still under 18 and not 18 and above in most cases involving the law. That was her ploy to try and railroad anyone who wanted to have communications with her in the first place.
So yeah.....She knew just as anyone who has or had shot her during that time frame.... So again my advice to you (Florida guys)....double check your shit......:disgust |

Victims don't usually get prosecuted.

I've never heard of a minor being arrested for being the subject of it. |

In cases like this I think there very much should be consequences for her actions. "She forgot she was 18"?? (like someone said)... OH Please. No 17 yr old forgets they aren't 18, and since when is that a solid legal defense? The "I forgot" excuse works now? Cool, I'll have to remember that. :D I just wonder if letting such kids off the hook when they willfully and knowingly pull something like creating/using fake ID to engage in porn is a good idea. Does it not set a very bad precendent? Kids are innocent no matter what they do? Sorry, no sale. Kids get prosecuted for all sorts of bad behaviour. 17 yr olds are often prosecuted as adults in fact. Is it ridiculous to prosecute kids for engaging in, producing, or distributing porn? Or is it more ridiculous not to? I'd like to say I live in a world where no one gets a free pass, everyone is responsible for their actions, even teenagers. |
