Florida authorities are charging Dirty D with two counts of the promotion of a sexual performance of a child, two counts of the use of a child in a sexual performance and one count of illegal computer pornography, which refers to the streaming of underage content.

A warrant was posted for his arrest last week.

Jenni Dahling, who acts as Dirty D's spokeswoman, told XBIZ on Thursday that he will indeed turn himself in next week.

"His attorney was able to lift the warrant so he will not be arrested upon entry into the U.S., but will be able to turn himself in upon his return to Tampa," she said.

Dirty D has tapped St. Petersburg, Fla., attorney A.J. Comparetto to represent him in the case. Comparetto, who was unavailable for comment on Thursday, specializes in entertainment law and Internet litigation, as well as bankruptcy and real estate law.

Dahling said that she will hold a press conference next Wednesday to discuss the charges against Dirty D.

Dirty D several weeks ago said that the claims made by a woman who says she was underage at the time of a Tampa Bay porn shoot in August 2007 are false.

He made that statement after XBIZ contacted him in Barcelona, where he just finished attending the Barcelona Summit.

Dirty D said that the woman, who goes by the porn pseudonym Kelsey Cummings, among others, apparently used a fake ID for productions that involved a sea of men in a gloryhole shoot and a solo scene at a home.

Police already have charged two of Dirty D's employees ? Shawn Chastain and Ryan Jay Holtz ? with two counts each of promoting a sexual performance by a child. Both have been released on $20,000 bail.

The woman, according to police reports, said Chastain, Holtz and Dirty D all were aware that she was under 18.

Dirty D denied the allegations by the woman, saying that her statements are "completely false and inflammatory."

Dahling spoke further on the allegations and told XBIZ on Thursday that the charges filed against Dirty D stemmed from an individual who was out to get him.

"[T]there is a lot of drama created by the person who started all of this ? it wasn't the girl ? and it's becoming apparent to everyone that this person had an agenda that targeted only Dirty D, even though the girl had shot with other producers at the time and actively sought to perform in his videos.

"She admits to lying, using a fake ID and has a police record for other misdemeanors," she said. "At the time when Dirty D initially found out that this girl may have used a fake ID, he promptly removed her content from the sites and sent a letter to his affiliates telling them to do the same."

Dirty D operates GloryHoleGirlz.com, GhettoConfessions.com, RealOrgasmVideos.com, GangBangHood.com and AlmostFemale.com, and produces and distributes related DVDs. He also owns affiliate program HowIGotRich.com.

Police were tipped to the case when they received a mailed letter that included photos of the woman in the act of fellatio on the site GloryHolesGirlz.com.

Police served warrants and seized much of his Tampa Bay-based business operations and took cash, videos and 10 terabytes of data, Dirty D said.

Who ever had an agenda against him, i hope to never piss off that person. IF (and none of us knows for sure either way) he is really innocent his world has already been fucked up. Think of the money lost on attorney fees, lost affiliates and sales, your reputation, etc...

I'm not going to put down Jenni, but seriously, as one bay area resident to another, rethink this.

Right now on the public stage of mainstream media this is playing out very low key for what it is. There has been a bit in the papers, but as far as I have seen, it's not on the evening news, it's not in rotation on Bay News 9, you're flying under the radar.

This isn't like what happened with Voyeur Dorm- true or false the allegations are that a minor was used to film adult content and was mislead to find herself in an exteme and unsafe environment. This is some very inflamitory shit any way you slice it. No one is going to want their names attached to this.

If D is innocent I pray he is found not guilty, but if he truly is innocent of these charges the damage that will be done by drawing attention and giving this issue further exposure will far outweigh what ever short term gains may be realized by traffic and sales that may come from the press. Hopefully the lawyer will realize this and pull the plug, trying to stir the shit with this is just going to taint the jury pool. There is no way with the elements surrounding this legal issue that the facts can be spun in such a way that it will cast a positive light on D to the local general public. No news is good news. If Casey Anthony can't get a change of venue there's no way in hell they will ever grant D one.

If he still has a business. How many affiliates have already jumped ship because of potential CP, or being worried about future payments ?

He could rack up 100K's in legal fees. He might not have a business left after this is all said and done.

I never give statements on the behalf of my clients even in civil cases. Its not my case to comment on.

In a criminal matter you never say anything. Unless you are a well known high profile criminal defense attorney that has certain reporters in your pocket that you know will get out your story in the exact way you want it out there - basically the guys that will let you write your own statement and will not twist it.

Otherwise it is a huge risk to take.

Good-luck with his defense though.

My Pop and Uncle always drilled it into my head to never, never say a word to the authorities, no matter how small the offense. To this day I will never speak to authorities no matter what, no even my name.

I imagine that the documentation of lack of will play a big part. If Dirty D has clear color copies of her ID then it shows that he was following procedure. We don't really know enough to make any judgements at this point though.

I wanted to clarify that my comments were not directed at you, Jenni. Outside of seeing you post on gfy, I don't know anything about you, or your company.

But I personally fail to see how *any* comments to the press are beneficial to DirtyD. In this thread, we have Shelly, a resident of that area, telling us that, thus far, the case is pretty much under the radar. What on earth could be gained by someone (you or the attorney, not sure who is giving the press conference) in essence, jumping up and down, waving their arms, screaming at the mainstream media

"Lookee, lookee, lookee!!! My client has been charged with a crime that has the words "child" and "sex" in it!"

On GFY, we may sit here and debate whether it matters if she was 17 and not 18, what her culpability is for using a fake id, etc, etc. But mainstream America isn't going to quibble over those points. They are going to hear "porn" and "underage" and that will be the ballgame, ladies and gents. Sure, there will be some that will actually wait until the facts are heard, but they are not in the majority.

And while stuff that has happened in his past may not be relevant and allowed in court, the media...and with all due respect to XBiz, I mean the mainstream media...will have a field day with stuff like getting a blowjob from another guy in a public theater during a porn movie.

No matter what the Court finds, DirtyD will be found guilty by public opinion about two paragraphs into a press conference.

Seems like an attorney who wants to make a name for himself to me.

To me, the only comment that should be uttered by anyone involved with the defense, or the defendant should be along the lines of

"We are confident that after the Court/jury hears our case that Mr. Whateverhisnameis will be found innocent on all charges. No further comment."

Then again, I am not a lawyer, nor do I play one on TV.

I hope this doesn't come off like everyone's trying to jump all over D's camp, there are alot of constructive comments in this thread that I hope will not be ignored. I will be the first person to say that this entire legal debacle was set off not by a concerned citizen but by someone with a personal vendetta against Dirty D. And as much as I agree it is completely fucked to involve the cops and try to destroy someones livelyhood and possibly take away their freedom over personal bullshit, that shit doesn't matter. It doesn't matter to the cops, it's not going to matter to the judge and it certainly won't matter to the jury.

Once the whistle is blown it doesn't really matter that much who blew the whistle and why. The only thing that matters is was a crime comitted and if so, who knew what and when. If you get caught with your hand in the cookie jar, it doesn't matter if the cookie tasted good or if the kid who ratted you out was a total prick bastard just doing it for his own amusement. Pointing the finger and saying the cookie was bad or the person who tattled on you is fucked up for ratting you out doesn't really help the case when you're sitting in a corner with crumbs on your shirt and chocolate all over your face.

Seriously, the best thing is just to lay low and address the charges in a court of law. If D's found innocent, fucking go wild. Hold a press conference, scream it from the rooftops, ride the positive press wave all the way to the top, I'll cheer you guys on, but doing anything pre-trial is only going to be to D's detriment. :2 cents:
