I buy a homegym, the guy who sold it crashes my car window when loading - who´s to blame?
 

Today I bought a used homegym and me and the seller were loading it into my car. Eventually we got it in there and the guy pushes the trunk (eh... ? on a hatchback)without noticing one of the parts touching the window. One second later the whole thing goes "bam"and the window shatters into 10k pieces.

Who is to blame?

Unless I had already warned the guy to be careful or thought he was drunk or something, I think I'd just have to suck it up and pay for it out of my own pocket. :2 cents:

If it was a business you were buying from, it would be their fault no problem. If it's just some guy, then it's a whole other thing. You can't ask him to pay for it.

One time I went out for a loaf of bread, and I got a ticket for making an illegal right on red. That was the most expensive peanut butter and jelly sandwich I ever had.

Not nessessarily, unless they have loading procedures & it is part of the job. Even then, most people that carry bags to a car for a person shall usually allow them to load the car or you can find a taxi likes to take the bags from the car & place it on the ground next to the car & like wise with packing :2 cents:


Truthfully chupachups, he was doing you a favour & I bet he feels awfull. I think maybe it is one of those things & maybe next time remember to load things into your car yourself :(

I once loaded a motor bike into the back of a van, my van, my mates bike. I was doing HIM the favour of moving it to his new address. As I closed the back, the handle bar popped the back window. I did not blame him as it was my van, my window & my fault that the wondow broke, even though I was doing him a favour :2 cents:

Next time anyone says, I can help. Accept the carry, but deny them the part of actually placing the item inside your vehicle.

It seems like he will give some discount on the product sold. Yes, I think he was uncautious but nevertheless he was helping me out. I will have pay about 200 bucks of the damages (whats that called - for the insurance?) if the insurance covers it, which it should.

None of those examples are close to what happened here. He was getting help from the person to load his car, he was not the victim of vandalism.

MY FACTS: I am too fucking lazy to go to the gym and I always find some excuse not to. However, a year ago I bought a treadmill and I have been walking 2-3miles daily since then. Use some will power, put on a bad soap on the box and you will make it:)

I don't know why I would even waste my time on a useless little troll, but what does vandalism have to do with this thread? In any case, you would still be responsible for all of those scenarios unless you actually caught the person doing it.

Whoever closed the hatch on the home gym and broke the window is the one at fault. Its not that fucking difficult to comprehend.

I'd go with 50/50. If I was selling someone something and it happened, I'd at least offer 50% of the money to repair. It was an accident, but you should be taking more care of your car as well, especially what is loaded into it and how.

You guys are missing his point. His point is that "your car, your problem" doesn't make
any sense. "Your car, your problem" would apply to the cases he listed. His point, I think,
is that it's not decided by whose car it is, but by who is receiving the favor. Example:

I borrow your truck to carry exercise equipment in. Your truck is damaged in the course of
hauling my new exercise equipment. Your car, your problem? No, you did ME a favor by loaning
me the truck, so I need to get it fixed.

I admit I only read the first post, so here's my reply.. He took the initiative to grab the hatchback for some reason and slam it down. His fault entirely. It's a not his car is it? Did you tell him to slam it?

If it were me who smashed your back window by being an idiot and slamming it on my own without asking you, I'd be reaching into my pocket for my wallet before you even complained.

He owed you a duty of care since there is a contractual relationship between you (buyer and seller) and due to the nature of the activity. A reasonable person would have made sure something as obvious as a part sticking out would harm your vehicle.

I would ask for a discount off the homegym to offset the damages you suffered.

I would say you both should handle it like gentlemen and pay 50/50.

Don't you have insurance? Glass coverage to be specific? I had someone break into my car and they busted a window out and it cost me about 5 minutes on the phone, 30 minutes waiting for them to install the new window and a little more than zero effort to sign the invoice.
