I buy a homegym, the guy who sold it crashes my car window when loading - who´s to blame?
Today I bought a used homegym and me and the seller were loading it into my car. Eventually we got it in there and the guy pushes the trunk (eh... ? on a hatchback)without noticing one of the parts touching the window. One second later the whole thing goes "bam"and the window shatters into 10k pieces.

Hmm. Not a fun situation.
Unless I had already warned the guy to be careful or thought he was drunk or something, I think I'd just have to suck it up and pay for it out of my own pocket. :2 cents: |
If it was a business you were buying from, it would be their fault no problem. If it's just some guy, then it's a whole other thing. You can't ask him to pay for it.
One time I went out for a loaf of bread, and I got a ticket for making an illegal right on red. That was the most expensive peanut butter and jelly sandwich I ever had. |

It seems like he will give some discount on the product sold. Yes, I think he was uncautious but nevertheless he was helping me out. I will have pay about 200 bucks of the damages (whats that called - for the insurance?) if the insurance covers it, which it should.

Whoever closed the hatch on the home gym and broke the window is the one at fault. Its not that fucking difficult to comprehend.
Lets put it this way: If you had closed his hatch and broke his window, it'd be your damn fault wouldnt it? You can be damn sure he would say so. |

I'd go with 50/50. If I was selling someone something and it happened, I'd at least offer 50% of the money to repair. It was an accident, but you should be taking more care of your car as well, especially what is loaded into it and how.

I admit I only read the first post, so here's my reply.. He took the initiative to grab the hatchback for some reason and slam it down. His fault entirely. It's a not his car is it? Did you tell him to slam it?
If it were me who smashed your back window by being an idiot and slamming it on my own without asking you, I'd be reaching into my pocket for my wallet before you even complained. |

Don't you have insurance? Glass coverage to be specific? I had someone break into my car and they busted a window out and it cost me about 5 minutes on the phone, 30 minutes waiting for them to install the new window and a little more than zero effort to sign the invoice.
