The Obama administration on Friday urged the Supreme Court to prevent Arizona from enforcing a law that punishes businesses that employ illegal immigrants, arguing that federal immigration law trumps state efforts.

The administration's views, contained in a new filing at the high court, are similar to concerns President Barack Obama has expressed about a new Arizona law that cracks down on illegal immigrants.

When it takes effect July 29, the new law will require police enforcing any other law to examine immigration status if there is reasonable suspicion a person is in the country illegally.

Obama and other administration officials have illegal immigration is an issue that must have a national solution rather than being addressed on a piecemeal basis by the states. The Obama administration is contemplating a court challenge to the new law. Justice Department officials met face-to-face with Attorney General Terry Goddard and aides to Republican Gov. Jan Brewer to elicit information from state officials regarding the Obama administration's concerns about the new law.

In asking the Supreme Court to take the employer sanctions case, the Obama administration said federal immigration law expressly pre-empts any state law imposing sanctions on employers hiring illegal immigrants. The administration added that if Arizona businesses knowingly use illegal immigrants, the businesses can have any of their state licenses suspended or revoked.

Lower courts have said that the Arizona law is not pre-empted by the federal law. That should be reversed, acting Solicitor General Neal Katyal said in the Supreme Court filing.

The Arizona law disrupts "a careful balance that Congress struck nearly 25 years ago between two interests of the highest importance: ensuring that employers do not undermine enforcement of immigration laws by hiring unauthorized workers, while also ensuring that employers not discriminate against racial and ethnic minorities legally in the country," Katyal wrote.

Phoenix attorney Julie Pace, representing the trade associations that are challenging the Arizona law, called the Obama administration's position "good news that the federal government has gone on record supporting the legal challenge to the constitutionality" of the Arizona law.

here in Arizona illegals teach their children(anchor babies) spanish as their first language so their dumb mistake the tax payers pay for. there's a program set up to teach them english.

Then why in States like Oklahoma where it is Criminal to hire an illegal, housing costs haven't increased or food costs?

It's simple really... Lets take housing, if the demand is to build 10 houses and it takes 3 companies do build those 10, and 1 has all/some illegals. When that Company can't operate anymore, the other two legal companies grow, hire more staff and "keep the supply of money in the Country" through legal workers. This also puts more money into American consumers which statistically purchase more than anyone, and again keep the supply of money in the Country.

Farmers are watched by ICE pretty hard and have clear paths to temp labor during harvest time. So them abusing them system, is nothing more than pure ass stupidity and abuse. Anyway, that's another reason why food costs won't increase.

This is such BS reasoning. Food prices wouldnt increase at all. Instead of illegals they would just hire teenagers again for minimum wage, the way it used to be. Back in the day it was a teenage right of passage to work at a fast food joint (think Fast Times at Ridgemont High). Now you're hard pressed to find any (at least in Vegas/Southwest).

That would solve a few other social issues as well.

Actually this isn't true. There was a story on CNN (I think, but it may have been another news network) several months ago where they pointed out that they could triple rages for field workers and it would end up costing the average family about $50-$100 a year more in food costs.

Again, farms have paths to bring in workers, cheaper than normal labor, no insurance, etc.. Most Farms have laws/rules that govern them to check for legal status of citizenship. As well they have rather easy paths to bring workers in for harvest times. They can lose the farm if they hire illegals.

Last year Vermont dairy farms were busted, some 2000 Mexican workers, almost all legal workers here on a Visa, working for far less than min wage. However some mixed in had illegal ID's....

We have a reasonable path to citizenship, it just takes awhile. Farm visa wise, it's no issue at all. The problem is almost all illegals crossing over the southern border, wouldn't have ever qualified for citizenship or a real work visa in the first place.

No doubt. But, I seem to notice that kids seem a lot less eager to go out and work. I know that kids that want to work always seem to be able to find jobs. Most don't really want to, or are too picky about where they will work.

It's not just fruit pickers man. In FL for example the illegals have taken over most construction jobs. There are plenty of Americans that are willing to do that job.

I agree on the fruit picking thing as no one wants to do that, but it's not the only jobs they take.

I support Obama on most things but IMO he should stay out of this Arizona thing. TBH, it doesn't matter what the Oval office says, the state will find a way to do it one way or another, right or wrong. (Look at Cali and the Pot stuff for example)

I think the law likely violates peoples rights, but that's something the court system should find out, and not something the Fed govt should be getting involved in.

To be fair, the only reason he's getting involved is because Mexico is bitching up a storm about it, so it's causing international issues between our two countries. Not that it matters to me, but really we do need a good working relationship with Mexico or the immigration and drug smuggling will get even worse.

If not for the international issues, I don't think he would be getting involved in this..

The difference is less in the kids and more in the parenting I think. Even just 10-15 years ago when I was a teenager, my parents made me start paying rent. These days, parents let their teenagers do whatever they want because they're afraid of making them more rebellious or some shit. "Hands off" parenting.

Once again, what you're not grasping is that when you take out the illegal immigrant equation and the corporations have to pay a higher wage, Americans and legal immigrants will do the job. Yes, nobody with a brain or not desperate will pick fruit for $3 an hour. Hire legal workers and raise that to $10-$15 an hour and you will have takers.

It's a total line of crap to make the blanket statement that illegals are doing the jobs that Americans refuse to do. The accurate statement is illegals are doing the job that Americans refuse to do for that price.

The fundamental problem is the business industry that hires these illegal workers to drive down wages. And now Obama is pressing to overturn laws that punish these businesses for hiring them. Thus the thread title.

Stop spending so much time (money) on the border trying to keep people out and spend more time (money) drastically increasing the punishments for businesses that hire illegals. Massive fines, closures, jail time. Make the risk greater than the reward of cheap labor. When the jobs run out you wont need to spend as much on the border as they wont be trying to get in. Fight the cause, not the effect.

It's pretty obvious the Democrats are getting involved and making it their fight to court the Hispanic vote. They know they have their hands full in the upcoming elections and if they can get Hispanics into the voting booths because of this hot button issue they'll vote Democrat. Might even allow them to take traditionally Red states like AZ and TX.

Yep. Hispanics typically do vote democrat, when they vote. The democrats see this as a way to motivate those Hispanic voters during a time when they may not be to interested in voting.

No, he understands that his base is going to support him no matter what and a typical Democrat will still vote Democrat regardless of his views on the illegal immigration issue. Hispanics are divided on the issue as much as anyone else.

The door would swing both ways, if they're for it and he goes against it, it could motivate them to vote against him or the democrats. If this is going to drive people to out and vote, then it works both ways.

However the law is going to be found to be legal, AZ is going to enforce it and by Nov this won't be a topic that anyone cares about.

There are 1000's of Americans who are un employed and will do anything to find work. They will do anything to put food on the table. So stop talking like idiots. Whether its working on farms or doing constructions or even washing dishes. There are people who are willing to do that.

I personally know few well educated people here in the SF who are doing odd jobs now to pay their bills. Yes they all wished they had their dream jobs , but when you are hungry you will do anything to buy food.

Businesses hire illegals so they can milk them out for all they want and know darn well they won't report to any one. You think their working conditions meets country's safety guidelines ??? hell no. There are 1000's of work related accidents and abuse goes behind these closed factory walls that go un reported. So by enforcing this law, we are actually helping the workers.

If every state enforce the law and go after businesses that are heiring undocumented workers, we will not have this problem. Illegals only come to US, because they know well they can get work, open bank accounts, buy house and do everything as they please and no one will do anything about it.

If each state, enforce its & federal law by the book, no one will want to hire illegals. Stop drinking the cool aid that the media feeds you. I am sure you have at least some basic critical thinking skills to see passed these smoke screens.

Let Arizona do its thing. I wish California will do the same, start cracking down on illegals and businesses who employ them. If that is going to make me not be able to buy Jack in the box's Value meal for $3, let it be. I will eat less and be less fat.

Yes it will suck, families will be torn apart, businesses will fail, blah blah blah, but at least down the road US will be able to provide a better quality life for its citizens. There are 1000's of foreign workers enter US every year on workers visa. Yes its tough to get a US visa, but its also what allows US to attract the real qualified talent.
