County official in Oregon apologizes for overzealous officials

7-year-old told: No license? No lemonade!

PORTLAND, Ore. ? A county official in Oregon has apologized after health inspectors soured a 7-year-old's business venture by shutting down her lemonade stand. Multnomah County Chairman Jeff Cogen, the county's top elected official, said the inspectors were "following the rule book," The Oregonian reported, but that regulators should take into consideration the intent of the food safety rules: To govern adults running professional food businesses.

Cogen's apology came after inspectors cracked down on Julie Murphy and her mother, Maria Fife, after they set up a lemonade stand at a local arts fair in northeast Portland. After just 20 minutes of selling the drinks, made from gallon jugs of water and Kool-Aid packets, an inspector asked to see their license, The Oregonian reported.

According to state law, even the ubiquitous summertime children's enterprise technically needs a temporary restaurant license, at a cost of $120 for one day. After giving the pair the choice of continuing to sell the lemonade and face a fine of up to $500, or pack up and go home, the mother-daughter team opted to leave, the newspaper said.

I don't believe these "it's by the rulebook" fucks. Use your brain. If the rulebook says you need a permit, that's fine, but consider the situation... take a proper note somewhere of what's going on, consult with a supervisor, do something instead of relying on that crutch.

And $120 a day for a vendor's permit at a fair? I don't even believe that.

People who grow up in "zero tolerance" schools dont know how to exercise judgment on a case by case basis.

Not only that, but because of their size, they physically have less surface area to conceal shanks & shivs & prison smokes. And they're easier to control out in the Yard.

i would have just set up a stand beside them, gave away the lemonade for free and sold advertising on the stand.

my reasoning is based on the fact she's competing with stands that did pay the $120, and her parent was with her

if this kid was allowed to do this, next year all the stands would have been run by children

So her parent should have stayed home and let the girl run it herself? Well, that's one way to push them into early adulthood.

But it's not a business. It's a 7 year old girl selling lemonade. Should the IRS crack down on her too? Does she need to be audited now? Make sure she's paying sales tax to the state, paying her share of unemployment, filing her quarterlys....
