amateurmatch being sued for dating fraud

Quote:

A group of self-described "lonely and vulnerable men" has filed a class-action lawsuit against the adult-dating site amateurmatch.com, [warning: link NSFW] claiming they were fraudulently seduced with fake e-mails from nonexistent horny singles.

The suit, filed in U.S. District Court in San Francisco, asserts that the business interests behind amateurmatch.com and related sites mounted "a complicated scheme to defraud millions of users" and enticed men to pay for subscriptions to the service "with the false promise that they are communicating with real women in their area who are interested in dating and/or intimate relationships."

Here's how it would work, according to the complaint: Some horny dude taking advantage of a "free trial" on amateurmatch -- during which he can only receive messages, not send them -- gets messages from fake women to persuade him that, hey, maybe this site could get him laid. The suit states that these are "automated Bot messages ... sent from different fake profiles."

For instance, two allegedly fake users named "luckysaga91"and "lapanistar" sent the same message to different guys:

Bird 09-13-2010 11:46 AM

It's in the terms and conditions that models are used on the site.

Caligari 09-13-2010 11:47 AM

amazed there aren't a million lawsuits against dating sites since they operate the same way. this could have huge repercussions.

chronig 09-13-2010 11:47 AM

I doubt they'll win the lawsuit... They'll just look like lonely pathetic fagg0ts :thumbsup

itx 09-13-2010 11:54 AM

andrej_NDC 09-13-2010 11:55 AM

Someone has to start...if they win, I'm sure others will follow.

Yeah, I'm curious what the consequences are. I doubt too much in damages, but I guess an injunction would change the dating site model in a big way.

V_RocKs 09-13-2010 12:10 PM

I am amazed at how many dating sites have solo models for those fake profiles and have had them for years.

kristin 09-13-2010 12:14 PM

The outcome of this one will be interesting.

pixovore 09-13-2010 12:35 PM

It s like if a video site pretend to offer this amount of content, and offers 1/3 of what it anounces...Just curious to see on how it ends up.

Yeah, here it is in their terms and conditions:

That does not mean they will win the case though...

If "dating fraud" becomes a coinable term, i mean, in the sense that lying about relationship potential in order to make money is a crime. Well look out women, you're all gonna get it, lol...

Robocrop 09-13-2010 01:01 PM

Any response from DG? are they aware of bots on their site??

woj 09-13-2010 01:09 PM

Just because they put disclaimer in terms and conditions doesn't necessarily make it legal... will be interesting how it all plays out...

Was this already there or was it recently added?

rowan 09-13-2010 02:39 PM

It's already happened in Australia, a dating company was sued by the Australian Competition and Consumer Commission (ACCC)

If GFY search wasn't broken (database error) I could link the thread. :(

Here's the Australian dating site that was taken to court

Jetplace Pty Ltd, the operator of the socialising and dating website wvw.redhotpie.com.au, has been ordered by the Federal Court to disclose that Jetplace created and operated well over a thousand of its own profiles on its redhotpie website.

The T&C are accessed through a javascript link (which doesn't work on my browser - it just ticks the checkbox) so it's likely that the search engines haven't found it. In addition, it's blocked by robots.txt...

Its been there for at least 1-2 years. I always found it interesting that AM discloses they use bots in their terms of service. Seems to be covering their asses pretty well if you ask me :)

What was the FTC case? There is nothing listed in the FTC case db for Match.com or IAC.

Brad Mitchell 09-13-2010 06:06 PM

It's about time a consumer did that. False advertising is false advertising according to the FTC. Very little gray area. I don't believe the guy deserves damages, but a refund might be in order if the correspondence was all fake.

I did a little research based on the case I remember. It turns out that it was a class action lawsuit in California. If I remember correctly, the FTC and California AG got involved, but in the end the lawsuit was dismissed.

I thought the FTC and AG had formally filed a compliant, but I can't locate anything that backs that up.

In any case, I am too lazy and I don't really care to do any more digging.
