Question to all content providers. Advice
I am assoicated with many girls for different reasons in this business. I use pictures of some of them for some advertising and a few of them are totally hot.
I was just wondering what the rules are in selling content that was taken by the models themselves or someone they know. I have had a few girls ask me if I could sell their pics for them and I have turned them down because I know nothing about it. Are there any brokers here or anyone that could help me with this or let me know if it's useless? Also is this legal, or do you have to be licensced to shoot adult material before it can be sold. Any help would be appreciated. By the way, some of the pics these girls have look very professional. |
No answer so.....
Bump before I pass out at my desk. |
I am not a lawyer, so dont take my advice as if i were one. i personally visited a lawyer and paid for 2k worth of documents and advice before starting off...
do the models have full exclusive rights to the images in question? (sometimes a photographer will pay a model, and also give her some pics for herself. doesnt mean she has the right to use them) and more importantly, do the models have proof that they are the sole owners of the exclusive rights to the photos... if not, i wouldnt sell them. there are an assload of content brokers on the web. the biggest is web-legal.com ... of course that means you are competing with lots of other producers. If youre just talking about a handful of pics of some cute chix, unsure of who owns the exclusivity, then its not worth it. otherwise, im sure you could get some advice from the guys at web-legal.com |

Take a look at the front door of my site for links to the 2257 and 2258 laws. Paul Markham Content Store It says you need the models IDs and a model release giving the photographer the right to resell the content. You then need the photographer to sign a release/contract so you can resell the content. Whether you need any license to sell the content will depend on where you live, ask a local lawyer. If you have the 2257/2258 documents contact me by email paul_eva at paulmarkham.com maybe I will buy the rights. Be wary of brokers. |

And I could be wrong they might be the worst pics in the world. I will post a couple later. Gonna have to find my old website CD around here first. I thought some of them looked alot better than some pics I have seen in paysites but that's not saying much these days. Anyway, thanks again for the response. |
It does not matter if the shooter was a pro. All that matters is that the models haqve given you the rights to resell and show their image. If not I would advise you not to show their pictures to anyone. You may be getting yourself into deep water.
Some of what MikeySpermberg is good advice, go pay a lawyer and see wehat he says. Be wary of asking a broker for legal advice and a lawyer advice on porno content advice. Some content brokers say webmasters do not need to have to have 2257 documents. One even said that 4 lawyers advised this, which is BS. So be careful getting legal advice from unqualified sources. It's your ass that will be in the sling. |
