It's not a good news, good news is when spankwire lose lawsuit.Anyone can start lawsuit.

Nautilus 11-23-2010 07:16 AM

The compiled a pretty strong case, I think there's a good chance of winning (read the pdf in the OP post).

It's still good news...because it will cost ol' Nathan/Fabian money on attorneys no matter what. And anything that costs them money is good news.

I would say , they have them on retainer, so it's just a normal day at the office:2 cents:

You're right...but it will still make them work and it will make Manwin sweat a little more. At some point it has to start becoming a negative to do what they are doing I would think.

ThumbLord 11-23-2010 09:04 AM

very interesting

SiMpLe 11-23-2010 09:19 AM

Taking a seat

DWB 11-23-2010 09:23 AM

Just read through the PDF, some interesting stuff in there. My guess is they will reach a settlement.

If you think about it, it is in Manwin's interest to make sure no case has a ruling and it's all settled. This way they can continue with their business model. Even if it costs them more to settle, it's worth it. Because as soon as a judge drops the hammer on their ass, they will be like a bleeding surfer in shark infested water.

They probably already have full time employed lawyers so it wont cost them more then usual.Even if it cost them more,i am sure that cost is 0.0000001% of their income.

Best post yet.

Until someone takes this to a court and a judge orders a Tube to open it's program, data base and books up there will be no winning against them. We need to be able to prove they upload content or don't delete after getting a 2257 notice, just "hide" it for a few weeks.

Of course if a plaintiff offered $50,000 for a paid employee with proof they uploaded content to come forward. Then it would be good. Assuming there is proof.

Settling out of court just means the game carries on, no change.

Fat Panda 11-23-2010 10:36 AM

i smell settlement

Agent 488 11-23-2010 10:38 AM

one would assume these types of suits are factored into their business model.

If it would actually go to court, I agree.

The wheel is turning in that direction for something that can help even the smallest guy prove those... well, all but the upload part, as only they can tell that. :thumbsup

arock10 11-23-2010 02:10 PM

since no one has said it yet, anything with a chance of winning will just get settled
