Saying that hotmomnextdoor.com was infringing on their "My Friend's Hot Mom" trademark.

The Complainant has failed to satisfactorily establish, on a balance of probabilities, the first element required under the ICANN Policy, i.e. identical or confusing similarity of the <hotmomnextdoor.com> domain name with Complainants MY FRIENDS HOT MOM mark.
Consequently, pursuant to paragraphs 4(i) of the Policy and 15 of the Rules, the Panel concludes that relief sought shall be DENIED.

of course you lost. it is enough for the arbitration to fail one part of the four prong test and you clearly failed the 'no legitimate business interest' part. when someone has a developed site, youre pretty much done. should have told the affiliate to read instead of bothering you and saved yourselves the money, the hassle and the negative pr.
