X on demand: BEWARE -- Long-term nonpayment

We dislike drama and very rarely take things public that should better be kept private. But we've gotten nothing but excuses.

I don't know if the problem is only with studios, or only with gay studios, but I do know that there are a number of gay studios who have been owed money by X on Demand for over a year. We've been trying diligently to get paid, and have gotten nothing but excuses.

Most recently, after a year of trying to collect, they emailed and claimed they are "trying to catch up" and offered us a payment of $50, with additional $50 payments coming "in a few months." The total we're owed is under $500, so it's a piddling amount, but similar to the Curious Cash situation, it's the lack of respect for the affiliate and lack of caring that's the issue.

Now, to add insult to injury, their affiliate rep is posting, offering higher payouts to new affiliates sending traffic. When I cornered him about non-payment, he dodged and said that he had nothing to do with payment, but would send a request to the accounting department (which has, of course, been dodging for months.)

So if they can't even pay their current bills, what makes any logical person think they will be able to pay new affiliates at higher payout rates?

Gota watch those VOD Providers, doesn't make a shit if it's gay or straight studio. The VOD game is the hardest, thinest, meanest niche in our Industry and many of them bastards have issues paying.

Hit up some of the other studios, it's sad to say this is normal across many (not all) of the VOD Solutions.

I'm waiting for the legal action to start slinging... more than enough proof to hammer several of these companies.

On the positive side, we're also with AEBN, Maleflixxx, Hotmovies, and Doggone Media. All of them pay like clockwork.

X-on-demand delivers us between 1/10th and 1/30th the traffic that the other providers have. Between crappy traffic and nonexistent payouts, I really can't understand why anyone would go with them.

Just a quick bump to remind people that X on Demand doesn't pay and admits they're broke. Beware, they are trying to entice new affiliates with promises of large payouts, but as someone at another board pointed out, 50% x 0 = 0 payout.

Interesting that yesterday, an XoD rep on another board promised to "get in touch with the accounting department" and get the matter resolved, but after a couple of PMs, he's gone strangely silent.

Our next plan is to do a DMCA request to get all of our content taken down and to assemble a list of all of their studios and contact them to suggest that if they aren't being paid, they take their content down.

We also have reason to believe that either they have absolutely no traffic, or they are not reporting sales accurately, because we know from at least 3 studios that XoD sales are about 1/40th of AEBN sales, and maybe 1/10th of it's next closest competitor.

Wether a site has few or lot's of traffic isn't the issue here. There will always be sites bigger or better then others.

That's because I was a little confusing

There are two separate issues:

1. They don't pay. We've been owed money, several hundred bucks, which they acknowledge they owe, and which is above their minimum payout. The money has been owed for over a year, and it's a constant and constantly changing list of excuses as to why we haevn't been paid. The most recent excuse is "we're behind and we're trying to catch up, we can only pay $50 this month and $50 more in a couple months" which, if they're really that broke, they might as well shut the doors.

2. We and several other studios have seen that their sales reports are always abysmally low. So either they are not reporting stats accurately, or they have absolutely no traffic at all. I don't know which it is.

3. While simultaneously telling us they have no money, they are offering to double payouts to affiliates... which is nice, but if they already can't pay using the current model, how are they possibly going to pay if they're giving twice as much to affiliates?

While the above may be a few hundred dollars, that's one example while others are owed 10k, 20k, 50k+.. and 'forced' deals are going down, like if you want to be paid at all, you can't stop sending traffic or the real fight starts.

You're absolutely correct with those numbers. Another that had similar payment issues is Gamelink. Either they have no traffic or are flat out stealing.

AJ, my business partner, spoke with Rob at XonDemand a couple days ago. Rob, after giving more excuses, did promise that he would get in touch with the president of XonDemand, supposedly the only person who could authorize payment. Rob committed to getting back to us no later than end of business Friday (i.e., today.)

In spite of a follow-up email we sent to Rob this afternoon, we've heard nothing, so, for the moment at least, it seems like just another broken promise.

It's also interestiing to note that XoD's new sales pitch is that they've spent over a half million dollars on new equipment and Flash technology in the last year or two, so if that's true, either they have money, or else they spent money owed to studios and affiliates on this equipment.

We are interested in hearing from any other studio or affiliate who is currently owed money by XonDemand. I have the impression that a lot of studios and affiliates are being stiffed. Even if it's only a few bucks you're owed, let us know, because we're looking into the possibility of asking for an audit of their records, and it would be interesting to see if there's a systemic problem or other indications of accounting funny business.

I have always had the best results with AEBN, both as a producer and an affiliate.

I'm not sure any of the stuff from my old line ever made it up on XOD, but this is good info to have cause I have a new line of dvds about to come out and I know for sure none of that stuff will go their way.

I don't know whether posts to boards or incessant pestering from us did it, but we received an email from Frank telling us that a check for the full amount we're owed will be mailed today (Tuesday). We later received another email from the accountant Cecil giving us the check number and telling us the check had, in fact, been mailed.
