Fabian(Nathan) Response Thread Regarding Manwin Piracy

Don't want to let things get caught in the fray... so why don't we start fresh here...

    From today's thread (http://www.gfy.com/showthread.php?t=987006)

kristin, obviously the fact that links were pulled is sad, but understandable. We will have to work on getting the program back on its feet. A lot of the content it has was very good and specific which was the reason why it converted well.
In terms of payments, as far as I know payments are currently delayed but we will help the old owners rectify this as quickly as possible, and once we take over operations payouts will be on us of course.

munki, we are not buying ALL sites, only those where we get proof that licensing is completely in order. If you think you have info for me I might not have, please do email me at [email protected]

I took screen shots as well, in case we run into issues later. These are all from my good friends site, and I can guarantee he has not licensed these for your use. That was an off the top of my head, no longer than 2 minute compilation of links I can personally verify as being on your site without producer permission or license. If I or anyone else on this board took a bit longer to dig, I'm quite sure the results would not be outwardly favorable for your company's denial of piracy.

How can you even pretend that Manwin is not involved in rampant piracy... it's laughable at this late stage in the game. Clean up... That's all I have left to say. Many will just see dollar signs, and I am well aware that you have a very long standing and well looked at reputation in our industry... that being said, stop stealing from producers and acting like you've done all you can.

I mentioned in your last Manwin announcement thread regarding Brazzers acquisitions and changeovers (http://www.gfy.com/showthread.php?t=978327), if anyone has the budget for a copyright infringement seeking technology similar to what Youtube is using, it would be Manwin. No excuses left, you are either stealing from hardworking people, or you are not. Which one are you?
Some clear, concise answers are, I believe, in order. Is Manwin going to continue profiting from piracy, or is the ship going to get cleaned up?

Nonetheless when DMCA'd they should take those videos down quick

I think the DMCA process is a bullshit excuse to hide behind. I won't even touch on the legal/illegal battle of similar tubes. We all are well aware over the past few years that many sites are obfuscating a piracy empire behind the legal technicalities of an antiquated DMCA process that people should not have to go through to begin with, if unethical business practices were not in place.

Sites such as Youtube received many DMCAs and eventually incorporated technology to immediately recognize and remove/flag material that should not have been on their site in the first place. If sites such as those referenced above are truly a user uploaded network, a few checks and balances put into place would not have them as you say "working on legalizing them", but would damn near stop the problem overnight.

I will on the other side of the board give a lot of respect to the sites for finding an amazing delivery model for content, that much of the industry is just hands down jealous of. You've conditioned your customers, and profits unknown, I'm assuming is quite lucrative given the acquisitions we have all seen lately... Bravo.

Stop profiting from piracy with some very real, public, and aggressive action, and I will shut the fuck up. I would kill to be proved wrong, or at the very least appeased with a solution, because that would be a much needed step in the right direction for this entire industry.

                    Munki,

I have said in the past, and will say so again. We are working on various things and when the time comes everyone will be told.

In the meanwhile, educate yourself in regards to DMCA and related laws... there is more to it than you think.

Hopefully more people will sue uploaders and downloaders to build a fund to go after the big guys.

Get behind those taking actions against pirates.

I am very well versed in DMCA and related laws, thank you... Over the past 8 years that I have been lucky enough to be a part of this industry, a good deal of my time sadly has been dedicated to research, meetings, panels, and bitching about piracy, DMCA, and douchebaggery in general.

I will keep repeating myself, with my simple statements until I see results from "various things". I'm not ok with theft. I'm not ok with a lack of ethics. I'm not even ok with thieves cleaning up shop and continuing to profit after previously unethical business, but it's become accepted practice around this industry sadly... le sigh.

                          munki,

I am sorry if you think we are not being ethical. I disagree. We will have to accept that we disagree with each other's approach to the changes this industry and the world in general is going through.

Just because you can get an 18 year old girl fresh off the bus and turn her into a coke addict and then offer her a job in porn to pay for said habit, it doesn't make it ethical...

I don't disagree on changes to the industry... your company has found the delivery method that is and will be king for quite some time, and I give you kudos there... as long as I am still able to find unlicensed content on your sites, we will have to agree to disagree on the ethics of the matter, though I look forward to long and healthy debate.

I fully agree with you here also, this business can be a tough one to be in and hold morals at points. I don't look forward to, condone, or appreciate anyone taking "18 year old girl fresh off the bus and turn her into a coke addict and then offer her a job in porn to pay for said habit" but this also happens. There are many things this industry needs clean up in big and small... I nip and peck and what I can, and do a lot of bitching to get there.
