ID/ 2257 Question
Not asking for legal advice, just people's opinion based on their experience. Is photo ID from a job acceptable as a secondary form of ID?

As I know, this is not acceptable, the best would be if second ID is for example drivers license.

Photo ID from a job? Do you mean like an employers ID card? I would say this is NOT acceptable as it has basically been produced by civilians (you could produce one yourself easily enough). Basically it should be a government document of some type which is why Drivers Licenses or Passports are the norm.

Thank you for all the posters who took the time to offer their opinion. I am still slightly confused though. Lucky I only deal with a limited number of models on a ongoing basis so its not a big deal.
Going back to my original question. I understand a primary id must be government issued. The question pertains more to whether a secondary id is meant to supplement a primary (in which case an employee id would be acceptable) or actually be a substitute for a primary id (in which case it must also be government issued). Like everyone should I ask for divers license/ state id and passport. But not everyone has a passport and honestly I would rather have a secondary photo id from an known legit employer or university rather than a social security card with no photo. Like I said, thank you to all posters (especially lacuna for the links). I prefer to ask these questions before I actually end up in a situation rather than after. |

While most producers ask performers to provide a secondary ID, the law and regulations do not require you to do so. Reviewing a secondary ID is more a tool for you to use to verify that the primary ID is legitimate. With that in mind, any picture ID should serve this purpose, whether it be from a school, employer, or whatnot. The key criteria here is whether it makes you the producer comfortable in relying on the performer's primary government-issued ID.
I advise my clients to have their performers sign an affidavit whereby they swear that their identification document(s) are legitimate. You can view and/or download copies here.

You dont need any secondary ID. And unless the first ID is written in crayon, you can rely on it. At a winter XBiz 2 yrs ago, the agent in charge of inspections indicated that unless a producer has reason to suspect the first ID is false the FBI will not hold that producer responsible if the ID is fake.
Nor would a liquor store be held responsible for a solid fake ID. People in this industry go way beyond with what is required by law. |
