Cease and Desist

One of my sites has just received an official looking cease and desist letter from an attorney in california by email.
The document said I was using images and content copyrighted by their client (a cam girl) and referenced the original cam site from where the images came from.
I am an affiliate with this cam sponsor and as far as I am aware allowed to use any content freely for promoting that sponsor.

Does this attorney have a leg to stand on?

Contact the sponsor. If they say you can't use the content in the manner you are using it then yes, they have a leg to stand on.

if its just a couple of photos just remove it and save yourself bigger problems. Respond to the email that you removed the content and your sorry for any inconvenience...very simple.

I would do it just because its the right thing to do. I terms of a legal issue if its pictures or video off the site then the girl can`t sue you as any images and video is owned by the site.
I run a sub studio for VS network (flirt4free) and they are fairly cool about using my own models pictures at will but I have to check their resource section for everything else.

Remember too that most of these site will pay some models to use their images for promo material or send their profile traffic so they don`t come across as exploiting the models and taking video from there shows without paying.

If you come across as having honest intentions you will walk away with good standings on all sides.

Yeah check with the program your promoting and if that material isn't supposed to be available, then take it down. I had a cam ho once had a bunch of shit available, a few months later she changed her mind and I had to take it all down. I was really pissed. I went through all this hard work promoting her and getting her traffic and she acted like a lil spoiled brat. It was very frustrating.

The schmuck that emailed you is not an attorney, as any attorney knows that a C&D or DMCA notice must be send via MAIL in order to have legal effect.

An email sent provides no legal presumption of delivery.

As far as I know the cease and desist should be sent to the user via mail. Now if this is a preliminary request, email is good. DMCA would intervene with the hosting party, not the user. Also contact the sponsor. Maybe those picutres were limited to his site and not available for affiliates. Worst case scenario, ask them to provide you with cam girl pictures that you can use to promote.
