It wasn't for "not using a condom". Her claim is that the condom broke and he held her down and came inside of her anyway... forcing her, hence the rape charge. The woman went to the police to find out if she could force him to take an AIDS test, not to report him for rape.

And for the record, I'm not saying what did or didn't actually happen, but this is what is CLAIMED to have happened and it is on that claim that the man was arrested. Not for simply not using a condom which would be fucking INSANE.
