Yeah I can understand why programs don't want affiliates running to the boards when most of the time its a simple misunderstanding that can be worked out directly between them. However, in this case, Dave not only chose to cancel affiliates without an explanation, but ignored emails from them asking what was going on. He left them with no choice but to go to the boards, and then ignored threads by them asking what was going on. Now it just looks like he changed the TOS so he'd have justification to keep monies owed.

Any affiliates getting burned by that TOS change should talk to an attorney if they have any sort of money at stake. Or just go to small claims if necessary. The only place on the planet I imagine that is legal to do would be Venezuela if Chavez decrees it to be so on a whim.

Actually, it says "or actions arising from disputes" so I think that is meant to mean you can't talk publicly about any actions they take against you. Presumably that includes actions like not sending checks though it's unclear if that includes lack of action like not replying to emails and not sending a check while not receiving any notification from them that you have violated their agreement is also a lack of action so you should be able to call them out publicly here for that and not be in breach :)

Actually, when I think back, this was on the horizon about a year ago. Back then I stopped receiving emails from Cyberage about new sales, but I still had transactions on my stats. As long as I was able to access stats, I thought the sales emails ended up in spam and I did not bother. Thinking back I believe it must have been a expedited scam by Cyberage to phase out affiliate payments by not letting people know about transactions in the first place - then go offline with stats bit by bit to go unnoticed when webmasters were cut off from stats and pay. That was a solid plan. It's so transparent
