Read the thread again, he was meaning Ebay "listing" not list and I posted the link to his Ebay page that he was promoting and explained it. He created an Ebay listing offering people $100 to signup via his link to Live Jasmin and make a $50 purchase, ($222 affiliate payout). He bought traffic from a broker and sent it to his Ebay listing and paid out $100 to a few people, but never got paid by AWE because they closed his account.

Advisor 03-11-2011 12:31 PM

Dave-AWE email me and ask how much I spent on advertising this allowed promotion.
I responded him within 30 minutes.
I hope AWE take right decision.
Waiting...

Ugh.... :) Nice catch. The other day I sent an email out to someone, and I said "hire" when I meant to say "higher". Must be my old age.

Well that might be true of course but I doubt it. Webcam consumers spend alot of money. Regular users spend hundreds of dollars a month, and "whales" can spend much more. It makes perfect business sense to me to wager a $222 commission. Personally I don't like this practice as it makes it harder for us smaller guys to compete for affiliates, but I can respect this practice. It probably takes them less than 2 weeks to gain a return on each $222 investment.

Also, don't forget: It's not in AWE's best interest to cut anyone off if the referrals are legitimate. Why would they? Paying out this much money for affiliates MAKES money for them.

OK... I see... And I have to say it looks like a swell proposition on paper... But then I think about it a little and I say to myself... This would not be allowed... The promotion isn't for this kind of stuff, it is for regular surfing traffic, SEO traffic... Not enticed traffic and I could swear I read something in the promos TOS about this type of thing.

Says Brad OK'ed it though... In that case perhaps AWE could reimburse him the costs.

An affiliate asked him a question whether or not his methods were against AWE's ToS. Brad said no.

AWE closed his account and are refusing to pay this affiliate after he was given the green light.

So what we can deduce from this is

A. Brad is an idiot and needs to be fired for not knowing the ToS of the company he works for.

B. Brad is a scumbag and purposely told this affiliate that he could use those methods, knowing the affiliate would be banned and funds withheld.

And regardless of whether those tactics are frowned upon in the industry, regardless if they aren't allowed, he asked Brad whether or not he could use them and was told yes.

You can twist this situation however you want, point fingers at some not so clear sentence in the ToS and use it as an out, or try to place blame on the affiliate... but the fact of the matter is this is on AWE. Had their rep not told him it was ok, then that would be a different story; but because he did, they need to settle up.

I agree that Brad should know about the TOS, and even if he didn't, he spoke for the company. However, the TOS says they do NOT pay out on suspected accounts. It's an interesting situation from a logical / legal standpoint. Regardless I hope it gets resolved to the mutual satisfaction of both.

Almost all programs have an inclusion in their TOS stating they can close an account for any reason. However, AWE does not specifically have anything in their TOS regarding incentivizing sales, therefore the thread starter didn't directly violate any of their terms.

There is no however... the only reason his account was labeled "suspect" was because of the incorrect info Brad gave him; information which, at best, contradicts some ambiguous line in their ToS.

Not that it ever will, but if this were to ever see a court of law.. all the OP would have to do is state that a. he read the ToS but being his native language is not English, he contacted their reps. Their rep told him it was ok, then later froze his account on "suspected fraud" and stole his money. He has proof of being told his methods of promotion were ok.

No matter how you look at it, it's a bitch move by yet another scumbag thieving company.

"also" refers to eBay terms and AWE terms, which are clearly displayed on AWEmpire.com. Please send me an email if you would like further clarification.

I like the way you truncated the sentence so you could add your own interpretation to it...

The actual complete sentence was:

"Currently we have no exact policy against it, but please also check eBay's terms and conditions if the allow it."

I don't see where that says (either directly or indirectly) to check AWE's ToS. If you truly think otherwise, you're obviously smoking something you probably shouldn't be.

Or maybe just outright lying to get out of paying the OP. We know how highly AWE thinks of their affiliates.

That's the worst thing of all this. People just don't get it. That you suspended his account and refuse to pay him after one of your reps mistakenly approved his promotion method is bad but the fact that you come on here and justify it by making things up and using weasel tactics is far worse.

It really does show the type of culture which likely exists over there and has existed for some time. Any webmaster still promoting these people is asking for it. Anyone remember the old affiliate rep for AWE who posted a few times about how they didn't believe affiliates deserved recurring revenue from promoting revshare programs and how it was "wrong" for webmasters to be paid even after they have taken their sites down? Ever stop and wonder where that employee probably got those beliefs from?

Any sane business without a God complex would have admitted to making a mistake and threw a few dollars to the guy in order to ensure it didn't come to this.

Walmart employee marks a product the wrong price. Walmart has to honor the sticker price, regardless of the difference. AWE employee gave bad information, the affiliate made some money and then AWE decides to terminate his account and not pay. That's bad business. :2 cents:

AWE, your employee gave false information and the man earned the money, just pay him what he earned and then terminate his account.

Advisor 03-17-2011 07:43 AM

Nothing change. Dave ask me for proof of my payments to people. I find as more information as I can and give it to him. Waiting....
Yesterday think post claim in facebook, twitter etc. But Dave email me question about proof, so I responded him an waiting.

I think it is humiliation, I must to prove that I paid people who sign-up. Strange, yes? But if they do not believe in another - I will provide all the information, what I find.

If you are mad man and decide to work with them - take screenshots of each step and shoot video! In another way - you may leave your money in terminated without any reason (or by mistake) account.

Lamis,

Tone down the talk of violence. This is your only warning. You can still express your frustrations without it.

Fornicating 03-18-2011 10:10 AM

Bump the thread.

A representative of the company is just that, he is trusted by the company to represent them to clients, his word is supposed to be the word of the company, and if he fucks up, then it is the company that is fucking up.
A TOS can be overidden by the company, and therefore as this guy represents the company, the TOS was overidden.

The rep fucked up, he authorised for this to go ahead, pretty clearly stated, also clearly stated to check EBay TOS, but not in contravention of EBay as his account there has not be closed.

Pay the man, you are already getting links pulled, it will cost more in the end.
