can't say that i am surprised.

you have to be logical here.

1) there is an opportunity.

2) the guy has no skin in the game. does not own high traffic domains, does not have adult businesses at stake.

3) he likes to talk. to everyone. and he believes the shit he slings, no matter who it's for.

4) the markets he has currently worked in are waining

its a no brainer. he has car payments and a limited skill set to apply to this industry. he's a talking head, and he's found a new thing to talk about.

it kind of is just what it is. the fruit is there to be picked and ICM is picking it, one piece at a time.

money talks.

What ever comes to pass will be. Most adult companies and site operators have no trademarks nor even a legit business.

To prove a Trademark though requires a few things and unless you know what you are doing to enforce a trademark it will cost you money to prove it.

I am not an advocate I am merely saying some people will buy .XXX to expand there business and protect or capitalise on trademarks. Either way its a shit storm.

In theory....
When the processors move in and start transacting .XXX what will you be doing? You will be staying with the transaction provider I would hope as matter of business. But... You would be doing business with guys that support .XXX since those transactions providers ultimately process .XXX sites. or will you cashing out transactions providers as amatter of ethics?

No matter how you kick it you will learn to cope it one way or another. You can black list companies sure but when those companies you depend on turn the page where will you be?

These are things each webmaster will have to decide.
The ones talking out there ass screaming they will black list anyone associated with .XXX or doing business with .XXX is full of shit. If they stick to those principals they are going to stonewall themselves into a corner and be forced to make a decision.

Decide where you will sit now just so its not such a shock down the road.

You think for a second that if CCBILL decided they will transact .XXX that affiliates will be pulling links to programs that use CCBILL? Fuck no. You think programs that buy .XXX domains will have webmasters pull links? Fuck no.

Best bet is to watch what you say because in the end you will be forced to deal with .XXX if it does go through. You will back peddle and make exceptions and excuses.

Not really...you just look the trademark up on the govt. website. Happens everyday.

Back in the late 1990's we took "ampland" domains from people all over the world. Even ones that were just skirting with it...and even ones who made up headers that tried to look like us. We didn't spend one penny doing it. Just a few emails. :)

As I told you in the other thread, you do not need to buy it as a preventative measure. If you are big enough to be concerned with someone taking arielrebel.xxx you are certainly big enough to have legal counsel if you can't understand the policies in place to PROTECT YOU. A trademark will also protect you for all tld's. .xxx is only the beginning, there are companies trying to push through .porn, .adult and even .kids. Are you really going to buy everything?
As for us, if any affiliates want to buy the .xxx for our paysites and send the traffic to us we will sign documents stating that we will not take the domain as long as you only promote our sites on the domain.

Having been in more than one domain dispute over domain trade marks I can tell you it cost $1600 to file the dispute with ICAAN. There is another $500 charge should you want to rebut what the alleged infringer used as their defense.

So it's time consuming and costs quite a bit to go after a domain you think you have the trade mark right to. You do not need a lawyer to file the complaint or to fight it but the larger companies that came after me both used attorneys adding to their cost.

ICAAN found I was not using these domains in such a way that they infringed on the trademarks of the companies that came after me, so it costs me nothing but time. If you have your proof and someone is infringing on your TM you have a good chance of getting the domain but it will cost you to do so.


As far as .xxx goes I am against it, as far as Chris taking this job it's no business of mine, guy has to do what's good for him.
