Police state is the end game. Period. Never thought I would see the day when the powers to protect were the same to possibly injure, or worse, kill mine based on a construded human sense that has error without accountability. Law, has given the police the keys and they will abuse this power as history shows, without recourse they Will abuse it to best of their ability.
Arm yourselves, trust yourself and those close to you. This shit is gonna get weird real quick. |

Supreme Court Folks!!! This is going to be the new norm (law), not good, not good for all! They no longer will require ANY truth, just a hunch...... |
Not sure about American law but in Canadian law, the smell of burnt marijuana isn't enough by itself to allow a search, the reason being that burned marijuana is already burned and there is no proof that the person is in actual possession of the drug. Last time I checked at least.
But the Conservative majority coming into power means a lot of that might change :(. |
I'm not advocating the legality of using pot, but I think this decision sucks for our fundamental rights.
Does this mean cops can now bust down someone's door claiming rape because their wife/girlfriend is a screamer in bed or claiming child abuse because someone's baby is crying? |
I can't comprehend this thread 100%, guess it's time for bed. :upsidedow

CROWN POINT, Ind. ? According to Newton County Sheriff, Don Hartman Sr., random house to house searches are now possible and could be helpful following the Barnes v. STATE of INDIANA Supreme Court ruling issued on May 12th, 2011. When asked three separate times due to the astounding callousness as it relates to trampling the inherent natural rights of Americans, he emphatically indicated that he would use random house to house checks, adding he felt people will welcome random searches if it means capturing a criminal.
Speaking under the condition of anonymity, a local city Police Chief with 30 years experience in law enforcement directly contradicted the Newton County Sheriff?s blatant disregard for privacy & liberty, stating that as an American first, such an action is unconscionable and that his allegiance is to the Indiana and federal Constitutions respectively. However, he also concurred that the ruling does now allow for police to randomly search homes should a department be under order by state or federal officials or under a department?s own accord. http://smargus.com/indiana-sheriff-i...rches-we-will/ |

In other words, they forfeited their own constitutional rights by their own actions. Had there not been the attempt to destroy evidence, any evidence would have been gained by an unlawful search and could be ruled not admissible in any proceeding against them. |

where i live now, a previous renter said there was marijuana odor in the hallways, which isn't closed you can see the parking lot and lake on each side, because some neighbors were smoking joints. Someone called the cops and since the hallways are shared the cops went on spree entering apartments - naturally they had to go in and search her apartment as well while trying to figure who the pot smokers were.
No warrant, no anything. Just based on smell cops enter looking for drugs because your neighbors are potheads! Pretty screwed up |
