Let me spell it out for you, I am an Australian citizen, anything I do which is legal in another jurisdiction has no interest to Australian law, neither would US law apply as all this talk of DMCA and Safeharbour is greek to me.

The problem is magnified if some offshore company owned by a group of other entities actually did the job. Then the only thing you'd get if you could even sue at all, would be the assets of the company because it would be the legal entity you may be able to sue.

Of course, as any good Phoenix knows, you just rise from the ashes while your opponent burns themselves to death wasting cash suing something with no value, therefore you might get a judgement but no actual enforcement.

Don't leave out the part where all the other videos that repeat infringer has uploaded get moved to your in-house "anonymous" account. Unlike sites with a REAL repeat infringer policies where ALL videos uploaded by a repeat infringer get removed.

I signed up to several manwin tubes under several nicks. I tried uploading content. I uploaded both legal and illegal content. The legal content never made it to the surfer. The illegal did. So somebody screened my video uploads and instead of blocking water marked, clearly illegal content they let it go through. The 6 to 8 minute stuff was all scrubbed. Hmmmmm?

I know tubes are killing our industry, but that idea is stupid. That's like saying you're going to bring down Microsoft by distributing copies of Windows for free. In the end, you'll crash and burn hard and not even make a dent in their business.

If you want to compete or affect their business, start a tube and keep it constantly updated with content from all over the net. The content harvesting must be done indiscriminately though, like they do. Then put aside a whole lot of cash for staff, servers, bandwidth, litigation, and see where the chips fall.

To keep the safe harbor, not only must they ban the infringer, they must also not have actual knowledge of the videos (with or without DMCA notices), and they must act upon obvious or suspected infringements.

my advice is be sure the content is user uploaded.
