Um I have never been beat down by a woman. Where did I say that? I have been punched kicked and scratched a few times. The hospital later told him it was a miracle he lived. He got charged with assault and sentenced to 2 years in jail and ordered to pay her 30,000 for pushing her. Further to this he gets placed on a violent offenders list for the rest of his life. Aside from the $30,000 she received in court awarded damages, she received 12 months social security benefits for trauma, was given a Government job and was hailed in the media as a survivor of domestic violence.

The guy had never did anything wrong in his life, not even a parking ticket.

Fight or flight, and from the looks of it he did actually choose the flight course of action which didn't work, and fight kicked in.

It seems that a lot of people here are confusing being charged with being guilty. From what we can see, it appears as if the girls went down (hee hee) and he proceeded to beat them - from that standpoint he was correctly charged. However, due to the counter we can't see what happens once the girls go down (hee hee). For all we know they are kicking, biting, etc and still pose a threat - and would logically be an even bigger threat if allowed to get back on their feet.

Since it is possible the first scenario is how it went down, the police had an obligation to charge him. If scenario 2 is actually the case, he will hopefully be exonerated or have the charges reduced. In any event, a good lawyer will press the prosecution to prove the mens rea, or criminal intent, beyond a reasonable doubt.

The article says he was additionally charged with criminal possession of a weapon - which is hopefully not in reference to the pole he grabbed. As a convicted felon it is unlawful for him to be in possession of a firearm, so if he was also carrying a gun then he is truly fucked.

First, you are making assumptions. Second, it's irrelevant from a legal standpoint what one might assume. It's about what a jury believes is a reasonable assumption, the presence of a threat and the severity of that threat and a proportionate response. You can always argue that had i not killed the guy, he would have gone home, got a gun and killed me. That doesn't make it ok to beat a guy to death because he throws something at you or gets in your face or takes a swing at you.

Knocking someone down thats coming at you and trying to hurt you for example, can be self defense... picking up a weapon, following them to the ground and continuing to beat on them with that weapon is felony assault.
