be nice..polite...and key..try to make a non offensive joke if they are open to it.

these guys normally deal with asswipes all the time...show them you respect them( even if you dont) and they do have the power to give you a break right on the spot.

Know I posted this before. Just can't find it.
Got off work, went to the grocery store. As I get out of my car, a cop car pulls up with 2 cops, One veteran, one rookie. In the back are 2 people, who I recognize as store employees. From what I hear, they've been cruising the neighborhood looking for a tall Black man with a beard tried to use a stolen credit card. While they we looking for him, he came in again (reported by another employee now standing with them.
When I get up to the door, the rookie wants to arrest me (short, white, did have a beard), as being the guy they're looking for. Older cop stops the rookie just before he's ready to cuff me.
Damn, that trip to jail would have been like winning the lottery. Hello lawsuit.

An officer does not have a legal obligation to answer you...but he does have the legal right to tell you to shut the fuck up and if you don't he has the legal right to arrest you for interfering with his lawful duty...among other potential charges. Your freedom of speech ends when an officer tells you to shut the fuck up.

If you think that a cop has violated any legal rights that you have there is legal recourse and it is not running your mouth at the officer. At some point you may run your mouth to a cop that has had a bad hair day...and you may learn that yes he is God.

One of my friends when I was in highschool became a city cop. He was the type that did not take shit from anyone in school or as an adult. As a cop his attitude remained the same and if you gave him shit he would light your ass up. He was a cop for three years before being fired for excessive use of force.

I don't know what gave you the idea that cops can order you to STFU but you are wrong. Same reason they can't tell you to turn off your fucking camera and all that jazz.

The thing is they can tell you to do it. Whether you decide to do it or not is up to you. If you are like this woman you end up arrested. The courts will decide if she is really guilty of a crime or not and she will likely sue so we will find out if the cop was guilty of excessive force or not.

If a cop tells you to shut up and you don't, it depends on what you are saying and how you are saying it. If you are just telling him you are innocent or that he has the wrong person etc likely there is nothing he can legally do to you (doesn't mean he still won't try), but if they are searching for someone they think is in the area and they think you are yelling to help that person escape or you are on the phone warning that person then you are interfering with them doing their job and they can arrest you.

Because it is the law and yes they can and do tell you to turn off your camera and "all that jazz". In some states...if not all...running your mouth is interfering with an officer in the performance of his legal duty for which one can be arrested. Some states are now making it against the law to film an officer during the performance of his/her job...and one state...if I recall correctly...has a fifteen year max for doing so.

Usually cops will let you run your mouth...as they are used to it and used to dealing the dumb and scum...but you are correct...it does depend on what you are saying and how you are saying it...and it also depends upon the individual cop and/or what kind of mood he is in at the time...whether or not he decides to arrest you for running your mouth/interfering...or non compliance.

The fact is running your mouth and non compliance gives them legal cause to arrest you...and let you tell it to the judge...if the prosecutor does in fact choose to prosecute. It is actually the prosecutor that decides what charges to charge you with and the charges may or may not be what the the arresting officer initially arrested you for. The prosecutor can dismiss all charges...or remove some charges...or add to the charges.

Reality is a cop can pretty much get away with anything these days. And yeah...most of it is dead ass wrong.

But here's the catch...you end up getting beat up and in jail. Then you have to pay to get out of jail and then any doctor bills. Then you have to pay to get a lawyer. Then you have to go through the hassle of all the time (and money) you are going to waste fighting it.

The cops know that 99% of the people they come into contact with are poor and can't afford ANY of that. And very few people who do have money are willing to go through hell...so everybody just shuts up and let's stupid cops push them around and act like jackasses because it's better than getting beat up and going to jail and wasting time and money.

Which I think is a ridiculous law and if and when that law is challenged and if and when it reaches the Federal Supreme Court I would expect it to be knocked down. I also suspect that a State Supreme Court would also knock it down...or at the least modify it...before it ever reached the Federal Supreme court.

All laws are only laws if they are not challenged in court and the courts allow the law to stand as being Constitutional. Laws are challenged virtually every day of the week from Local...County...State and Federal law...and many are knocked down or modified.

Yes that is the reality...so it pays not to run your mouth...give attitude...or not to comply. Be respectful...polite...and get on with your day is the smart thing...and mark it down as a minor annoyance. Hell I am annoyed about something virtually every day.
