Isn't protection for user submitted content a US law? Or has the EU adopted it too?

You arem't really breaking any laws if the content actually is user uploaded, and you do respond to takedown requests. But when the majority of videos are submitted by "admin", and your dmca link on the page is a 404, then you probably don't have the best defense if a copyright holder decides to sue you.
If you need to be a paying member before being able to upload to the site, then how did the first videos get on there? Did someone pay to become a member of a site without content, and then magically start uploading videos to it?

How does he get owned when there is no link to that page from your sites content pages? All videopages links to a blank 404 template.

For me it's not the question if this is against 2257 or not. But making a buck by knowingly using stolen content is just theft for me and probably for most ppl in here, too - at least those who don't steal content themselves.

Plus we all know that at 99% of these kinda sites it's not really user uploaded content, but actually an admin collected the stuff from forums and newsgroups and uploaded it. Not all webmasters are so dumb to upload them all as user "admin" on their own site, though :1orglaugh

i blame adminfella.

When I had my other tube site (yes it had all purchased content on it which i had to convert and upload through an FTP) which allowed user uploads but they wouldent convert because i did not have ffmpeg installed on the server, I was getting around 400 user submissions a month even though I sent out mass emails saying that it was pointless uploading movies because they wouldent convert, They still continued. You would be suprised at how many users do upload content.

of course, but people are skeptical when a tube (or paysite) launches filled with "user uploaded" content somehow, and also uploaded by adminfella.

1. Who said the site was launched with useruploaded content? Are you guys so backwards you dont even know how a tube is launched?
2. Who says im administrating the site. There are other reasons NONmembers cant see the members name who uploads the videos. If they choose too. Who says the UPLOADER is "admin".
3. You assume the links to copyright and everything else arent working, they are working perfectly fine. We have been responding to copyright notices and takedown request like we are used to, never had any problems.
4. You assume people dont upload videos. Open your eyes, take a look around. Smell the useruploaded videos on thousands of HUGE sites.
5. You assume when you see a familiar face on some of the videos i do not have the copyrights to it. Yet i buy content all the time.

And the funniest one, you assume the stats in my signature are from this site. Guess again, wrong!

All i want to add to this thread is that i simply love the hypocrits in this biz. 99% of you are sending traffic to programs you never check, or you even KNOW they are REALLY using stolen content. You guys promote exgf and gf sites, celebrity sites, voyeur sites. But hey, when its making YOU money who cares right?
