You are supporting some really weird fights at the moment Lloyd. First thinking it's cool for Lightspeed to try and sue IP addresses for allegedly sharing passwords, and then in contrast, supporting someone making money from other people's content.

So on one hand, stealing is bad, and on the other hand it is good?

Weird...

That's weird, yesterday or the day before, boneprone.com had full length videos on it and now the longest is 3 minutes.

Edit: you also used to be able to select from videos at 4tube, big tube, free view movies, jizz hut, keez movies, movie gator, porn hub, porn rabbit, red tube, shufuni, tnaflix, tube8, tubekings, you porn, xhamster and xvideos but now all you can access are 3 minute sponsor promo vids.

I think Private is going about this the wrong way. By attacking a high profile affiliate who embeds videos, a common practice in our industry, they are putting fear in the eyes of other smaller affiliates who do the same. However they are going to lose a lot in the eye of the general affiliates opinion.

A case like this has a lot of meaning to the future of our industry and the current affiliate model. If the courts side with Private on this issue, affiliates will become responsible for verifying the license of the content they are using. Google could even be held accountable for the advertising on search results that link directly to these videos.

I just can't see how this case has merit, beyond the obvious "scare-factor" it is already bringing around the industry.

Money well spent for Private as a company, but Boneprone is the unfortunate and unnecessary sacrificial lamb on what I believe is a misdirected claim.

The only affiliates it will scare are the one's using full length scenes.

I do not know of a single program that lets affiliates embed full length scenes.

Those that embed sponsor provided promo vids are not the least bit worried because this case has nothing to do with them.

I don't get how they are going the wrong way. The guy had full lenght videos in his sites!

I'm an affiliate and i will not be scared. I will be happy if sites that embed full videos go down.

As you noticed out of nowhere this does not seem to be a problem anymore. Just 2 days ago it was a major issue but not anymore. Actually everyone now hopes he gets away with it.

If Private is successful I imagine this will be the first of many cases. It's probably too late for those that embed, something that should have never been done.

I never understood embedding because it's virtually unknown to surfers that the site isn't hosting the video. It felt the same to me as if I'd just pay someone in India to upload to a tube or do it myself.

Easier to license older full length scenes and pad with sponsor promo vids with banners to their site under the player. One can license full length scenes for tubes dirt cheap now.

Of course it will be introduced as evidence. Character, credibility and business practices matter when it comes to proving a pattern of conduct. Either you are a liar trying to convince everyone you are something you are not for many years, or you are that baller and you're lying to a judge and jury to convince them you're broke and portray yourself as a hapless victim of a big greedy corporation.

All he's done on this forum for years for the most part is brag about personal success.

Also, would you want to be sitting there being cross examined about AnalHobbit posts? Or that idiot character son of sam or whoever who was supposedly in prison for manslaughter or murder or whatever?

I'm guessing there will be no BP4L signs being thrown up in the courtroom.
:)

Lawsuits of this kind are about making a point. I think the point in this case will end up being well made and well heard by all.

The Anal Hobbit thing could prove interesting. I don't know how he is in the court, but in real life Chad has a great sense of humor and could have some fun with that. Maybe Anal Hobbit is John Doe 47 and BP will have to explain him.

edit: plaintiff has requested a jury trial. I can only imagine all of the jurors sitting there listening to who Anal Hobbit is.

Huh??? Putting fear into the eyes of smaller affiliates doing the same? You're damn right they should be putting fear into ANYONE using copyright infringement as a promotion method or running an illegal tube site. All day long people on this forum are complaining about illegal tubes and now all of a sudden they support illegal tubes and copyright infringement? There's not a single program I promote that offers you the option of embedding all of their full length videos to run an illegal tube site. It doesn't matter if thousands of other people do it or he's just embedding from other sites, it's still wrong and illegal.

While it's true that nobody went after the tube sites in the beginning, they are certainly going after them now.

With the AFF staff kissing his ass on boards, Penthouse flying him on their private jet for vacations they pay for etc... and him gleefully posting it all here for everybody to see probably put a giant target on his back. He likely wouldn't be getting those perks unless he was a whale and whales usually have assets that can be taken, especially if they're in the US.

He probably wouldn't even have been on Private's radar if he had just pretended to be a small fish in a big pond. You typically don't waste your money suing somebody if there is nothing to gain except the ability to brag that you won.

A lot of the tubes with full length videos they do not own or license try to conceal ownership, host overseas, keep a low profile people wise, etc. Of course they're going to go after you if you're well known, reside in the US, don't hide what you're websites are, talk about being the biggest affiliate of a public company, etc.

You're right. God forbid someone actually be aware of the rights they have or don't have to a piece of someone else's content as they use it to generate traffic to their own sites and dating/cam/penis pill sales to other affiliate programs.

In some of them they did, and promised to refile later in another district with more easily provable ties to those tubes. And they also won several cases already, like pornvisit.com lawsuit where they were awarded 4 mil in damages IIRC.

Possibly, but I don't quasi blackmail people in order to generate revenue then brag about it.

Three questions

1) Why did you stop quasi-blackmailing torrent users last year?
2) How many John Does you tried to extort money from ever went to court?
3) If this is about stopping piracy and not lining your wallet, why don't you go after the initial uploading gangs?

But keep not answering that and calling me a cunt if you want. It does make you look way cool.

They didn't fail yet because they didn't run out of options so far - they can refile in a district that has some provable ties to xhamster, for example it could be where their cc processing or an advertising company is located. All of them do business with the US in some form or shape, and sooner or later some connection that is good enough to be admitted by court will be found.

Kink.com for example filed a lawsuit against a foreign tube DrTuber in Florida, where their DMCA agent and their billing company is located. If that will be accepted by court as a tie to Florida, that will pave the way for many other similar lawsuits against foreign tubes which will be filed in the US. It's not as hopeless as you picture it.

A lot of us on on this page....

most know Boneprone personally and like him, he's been around forever and part of what we consider family in this biz.

And Private is a stand up company in my opinion and seriously produces some of the best adult videos available period.

I agree IF content was stolen, Private has a right to recoup lost revenue. BUT I have no idea if what Boneprone was doing was legal or not.

for me, this is a case where I'd like to see an out of court settlement where both parties are happy.

but all in all I am VERY interested in the outcome.

I will say this much... I always figured he had some innovative ways of making money and was a smart cookie who "got it."

If it turns out that a big part of his success was embedding full length scenes from companies that didn't give him permission, then I will have no respect for him.

It's much easier to get to the top of this industry if you're cutting corners. I have respect for the people who do it ethically as they are fewer and further between.

Piracy hurts everyone from the biggest programs to the smallest affiliate.
