TheSquealer 02-10-2013 04:29 PM

First obvious step is to call police. Money is stolen. End of story. "I'll pay it in two weeks" is irrelevant. Try walking pit of store with an item - then if you get caught say "uh, yeah ill pay you in two weeks" and see where that leads.

Tick Tock...

People are fucking idiots and this is why this shit happens. Call the police ASAP. Done.

NaughtyNerdy 02-10-2013 05:18 PM

This sounds like the exact plot line of dont trust the bitch in apartment 23. Damn your friend got scammed. Go to the cops

Note: I have the other end of the bat .. A tenant that does not pay ... and I can`t kick them out till I get a court order.

if they saw the apartment it's probably not a scam and more of a fuck up

FreeHugeMovies 02-10-2013 05:53 PM

Someone who gives cash for something like this is an IDIOT.

its happening because the owners live out of state :2 cents:

Tony Soundview 02-10-2013 06:33 PM

Im from the soundview projects in the bronx and when someone steals or owes you money, here is how you get it back. 1. Consider the $1200 gone. 2. Scope out the neighborhood for someone willing to do a home invasion. If you're from the hood u know these cats. 3. Tell him, they have your 1200 cash and they can keep it if they can find it in the house. 4. Throw in and extra $1000 if they beat her mom and leave her on the sidewalk.

The legal process will take to long and will cost just as much.

You don't pay squat until you move in. Sounds like a scam right from the beginning.

The GFY lawyers are all over this one, i'm bowing out now...

signupdamnit 02-10-2013 07:15 PM

Have her contact the police immediately and tell them she suspects she is a victim of fraud. If it's a scam she might have a better chance of getting her money back if done quickly. If it's not a scam (and it probably is because who spends money that quickly) then getting the police involved will push normal people to pay her back ASAP or set things right. If in the states unless you make sure to push the fraud angle the police probably won't want to get involved and they will call it a civil matter. So it's important to state from the start that she suspects fraud and a scam.

they dont owe his friend money at this point. thats the problem. this person told them a story, but its not owed if they dont move in. no money is owed amiright? money was paid, keys given, they said the mother didnt approve, contract written. but that doesnt mean they cant move in. thus no money is owed to any one.

no fraud was comitted at this point

You can not be that naive.

woj 02-10-2013 07:32 PM

If it involves CL, cash/wire and some bullshit story, it's some scam 99% of the time... :2 cents:

let me guess... $1200 ($600 deposit+$600 first month ??) was a pretty good deal, a place like that usually rents for a bit more?

JamesM 02-10-2013 07:36 PM

tell your friend to go to the apartment and call the cops and tell them issue, get legal advice and sue her.

bl4h 02-10-2013 07:38 PM

whatever contract or lease that was signed to, will have to be broken in my opinion. i aint no lawyer. she needs to move in. not having a receipt for payment might be a problem. but dont let them get to the point where youd need to present that. thats why i say move in. or get fucked

Dunno what to tell you man. You seem pretty dense and very immature. Someone paid for something and either do to the misrepresentations of the seller or for what ever reason, did not get what he/she paid for. They are legally bound to fulfill their end of the agreement or return the money and even then, the person who offered to lease the place is liable for additional expenses incurred as a result of their either negligence or fraud.

Real estate law is also black and white. There is nothing to dispute or debate. Either the person had the right to lease it or didn't. If she didn't, then she is liable for the theft of the money. If she did, then she has no right to block the tenant from taking possession of the premises.

However, the fact that you would deduce that no one owes anyone anything suggests that you are borderline retarded. So yeah, don't call the cops. A bunch of degenerates on a porn forum will surely sort this out for you.

you seem to be the idiot. the OP said that the person who sold the apartment told them that her mother didnt approve of it. the renter has the keys in hand and can move in. nothing illegal even happened yet. retard

Yeah .... if she was given keys, then where's the problem ... just move in!!! :Oh crap

kane 02-10-2013 11:53 PM

If it were me I would do as others here have suggested. I would move in. When and if they try to kick you out call the police and show them the contract. Not much the landlords can do but deal with you and now you can come up with some kind of an agreement to get your money back.

Datebizguy 02-11-2013 09:53 AM

Call the Police, it sounds borderline " theft by false pretenses " most states
have laws for that type of thing.

You're a funny guy. What can I say, you've figured it all out. Your understanding of the law is perfect and in your world, people can go around accepting payments either under fraudulent pretenses (misrepresenting themselves as having the right to lease the premises), or by simply accepting payment for something and not delivering, later announcing the money has been spent. Either fraud was committed or they are illegally preventing the tenant from access to the property or both. Is that really too hard for you to understand, Einstein?

TheSquealer 02-11-2013 11:00 AM

I feel like the whole world is getting dumber and its depressing the shit out of me.

Anyone on CL that requires cash is a scam.

I'm sure the names used on the contract weren't real.

What about the passport/ID?

Anyway this whole story sounds fishy... if something like this happens, why would you not call the police right away? Instead you come to GFY to ask for advice?

slapass 02-11-2013 01:25 PM

I have been a landlord forever and people always pay in cash. Not unusual at all. Yes, they pay before they move in. Not sure if this person has zero belongings but moving if you are a normal person is a big deal. I would not move into a situation that might result in me having to move again in a few months. Now I am assuming she has somewhere to stay at the moment. The threat of police is great or court action but calling and working this out is the best method before any of that. And obviously you are not waiting two weeks ot get your money back. That is their way of getting you to wait and wait and ... wait so they can get away with it.

she probably does have the right to lease it. shes just saying her mother doesnt approve as an excuse to hold the girls money and lead her on indefinitely. and once you agree and accept not to move in, thats on you. no one has done anything illegal

you fail at law. youre why people get scammed

Police won't do shit, no proof this person said anything other than 'we have a lease'.

Now if you can show someone acted as an owner or an agent of the owner without authorization thats a different story.

She called and said "sorry, you can't move in" after finalizing a contract and being paid. She already admitted that she spent the money. She is not refunding the money. She says the tenant can't move in. It doesn't matter whether the tenant agrees or not to move in or with respect to the money that's now due/missing/stolen.

In a forum full of insanely dense people, you really are making the effort to stand out.
