I can understand that the office who was handcuffing her and took her down wanted to get control of her, but at some point you have to ask yourself what level of force is adequate. Handcuffing her is fine. If she was really putting up that much of a fight why did the other cop just stand there and do nothing? He could have grabbed her other arm. The two guys could have easily taken control of her without having to use a too much force. Instead, the one cop decides to slam her face first into a desk. To me that was excessive.

The department they worked for appears to feel the same way or they wouldn't have fired these two. By firing them and dropping the charges against her they are basically admitting that they are in the wrong here.

All over $100!!! 100 mistakes!!!!

That is the biggest point for me. This entire thing went down over a $100 fine not being paid.

I understand that they want to collect fines, but there has to be a better way of going about it than arresting people.

visit their house or if their stopped they go to jail and get the money paid by friend or relative and go home. somehow i think it was more than just about the $100 fine.

It doesn't matter "how much she was resisting". When you've been arrested and you are in a police station and the police tell you they are going to put handcuffs on you or put you in a cell, you don't fucking talk back and wave your hand at them. It doesn't matter what color you are; After the fourth or fifth time the cops are going to wrestle you to the ground and use force.

I guess we will just have to agree to disagree on this one.

Sure, a person in custody shouldn't resist and the police have a right to protect themselves and do their job, but I am a believer in the idea that the punishment must fit the crime. If she were trowing punches, kicking and really fighting them then I would have no problem with him doing what he did. It looked to me like she was talking to them and having a disagreement with them and he decided to face plant her.

I think there was likely a better way for this to have been handled.

dyna mo 06-06-2013 02:32 PM

i'll go ahead and say it.

coming up on someone from behind, grabbing them by the hair and smashing their face in the counter is punk ass shit you see in a yellow beer bar fight, not at the fucking police station.

it seems odd to even have this debate, the cops were fired, would the sheriff's dept offer themselves up directly to liability by firing those guys if it was not completely clear they were out of line?

hell no they would not.

strongly disagree with you on this one.

Being locked up has turned into a rite of passage for many blacks. They do not fear the modern criminal justice system. If stuff like this is what it takes to bring that fear back, then so be it.

And I'm not saying that just because I'm white. If that was a punk white boy mouthing off in the lockup I still wouldn't care. I would say he is learning his lesson.

You know nothing about black people. Quit fooling yourself that you do.

Your attempt to cause fear in black people will most likely be met with terror.

I lol'd when the cop went flying backwards and fell on his ass when her shoe came off as he was trying to drag her by her leg.

So when a prisoner refuses to go back to to their cell... what should the police do? Keep asking nicely until they wear the prisoner down? Maybe buy her a sandwich?

When a prisoner refuses to go back to their cell or refuses to put on handcuffs or pretty much refuses anything, they get forced.

When I watch the video I see no escalation of force. He grabs one of her arms and puts a handcuff on it. She isn't pulling that arm away or fighting with him, it looks like she is arguing with the other officer. Neither of them even try to grab her free arm. They don't grab her shirt and try to press her against the wall. Instead the one cop powerslams her face first into the desk.

Now, as I have said before, you can't hear what is being said so you have to take that into consideration, but it seems to me like they could have stepped their aggression up a little bit and at least tried to grab her other arm first. If they try a few other less intense things and she still is resisting then kick it up.

EDIT: I just went back and watched the video again. Fast forward to about the 3:40 mark. She is talking/arguing with one cop. The other cop comes up behind her and grabs her left arm and handcuffs it. The first cop grabs her right arm. They have control of her. She doesn't appear to be fighting them, but she is still running her mouth. That is when the cop who has her left arm grabs her by the hair and slams her into the desk.

To me she was not a threat to them. They had her under control and the level of aggression that was used was not needed.

Yeah, when the department fired the cops involved that was basically them admitting guilt. They will likely settle with her out of court, but it won't be cheap.

So now the city gets the expense of hiring and potentially training two new officers and they have the expense of legal council in the lawsuit plus whatever they are going to end up paying her and all of this came about because she had an unpaid fine of $100.

Well, what is the better way?

I think there is a lot going on here. It's not like you get parking ticket and fail to pay it in thirty days and they knock on your door. I'm guessing it takes six months to a year, and then they issue a summons - meaning you have to appear in court. Miss court twice and then they issue a warrant for your arrest.

What else can they do? Take your driver's license away? So when you get pulled over you get yet another ticket that you won't pay? Then what?

Some people are just stupid.

Putting a lien on property.
Seizing state tax refunds.
Offer a payment plan if financial hardship is claimed.
Suggest companies that grant small loans for this.
Deny equal amount from any state benefit program(food stamps).
Add to property tax of home owner.
Offer community service to work off the fine.
.
.
.
I could probably go on for a while.

Without knowing her personal situation in this case it is hard to say what they could differently, but businesses all over this country collect money from people who owe them all the time without arresting anyone.

There are always going to be cases where the people are just "in the system" or they know how to work the system. Maybe she is like that, but as I said, we don't know for sure. They could have done like the IRS would do and garnish her paycheck or seize her bank account or take money from a tax refund. If she doesn't have a job or a bank account it would be a lot harder.

I just think arresting someone and then ending up beating the hell out of the them over a $100 fine is ridiculous.

These are all good options. I love the community service one the most. If you are broke and can't pay the ticket, so be it, do some kind of work and trade off. That sound fair to me.
