These guys are not smart.. Most of them are below average IQ or they wouldn't be beat cops in the first place.. So engage first would make it clear as day. Did the kid even point it at them? Or just go for it? I do some what blame the kid for not listening to police to put his hands up. Or not shouting "it's just a toy". Still if you are a cop you are a peace keeper.. Your job is not to shoot anyone and everyone you think might have a weapon. If any Joe citizen shot this kid under the same assumption they would be charged with murder. In the Mike Brown case I agree with the officers actions. In this one I do not. |

Anyways I live in cleveland, and I get my haircut where some cops also get theirs. The kid in a description as described by a cop was mischievous but not bad, he did spend alot of time at the rec center and parents did not ever come to pick him up etc, when he did cause trouble the cop would talk to him but that was all that was needed. Basically to the cops who worked Cudell regularly he was well known and possibly unsupervised alot. Unfortunately, the responding patrol did something very odd that goes against any and all training, that is, they pulled their patrol car within feet of the suspect who is reported as possessing and displaying a handgun, which has scared members of the public. Additionally, the driver pulls up in such a way that his passenger (the shooter) cannot safely deploy, assess the situation, take cover, and make a fitting decision. If the patrol had responded by placing a safe distance between the suspect and themselves, there is a significant probability this would have been a quickly resolved non-incident. Who pulls "into" the scene of a potential crime and dumps their patrol partner within feet of an armed suspect? This death is the result of a complete procedural disaster. Im convinced that the kid never really heard or understood the officers command. You have literally around 2 seconds from when the officer deploys till when he fires so he basically hopped out shooting. The kid wasnt threatening anyone or pointing the toy at anyone, he did not break any laws. Ohio is an open carry state, and he was not in violation of the law. This case differs from Mike Brown by the fact the victim did not commit a crime before or during his encounter with the police. |

They should have been given all the information on their way to the scene and to me they should have pulled up 10-15 feet away from him and used the car as cover instead of hopping the curb and pulling up right next to him so that the cop in the passenger side had nowhere to get cover and felt exposed. |

I'm sorry, but in this case, it's another case of the 12 year old being stupid. If he took the orange cap off the end and was running around scaring people for the fun of it, whatever, but once the police showed up and aimed their guns on him and said to put your hands up, the shit just got real. In ANY case, the police must protect themselves, I don't care who you are, but if the cops know or believe you have a gun and you reach for it and point it at them after they say to put your hands up, you're gonna get shot. A 12 year old is surely smart enough to know that.
