UK Law

Previously, printing images of women aged 16 or 17 on Page 3 was deemed acceptable. In 1983, Sam Fox was the youngest at only 16 when she first featured topless in the paper with the headline 'Sam, 16, Quits A-Levels for Ooh-Levels'.

However, the passing of the Sexual Offences Act in 2003 resulted in the minimum age for women posing on Page 3 being raised to 18. This now means that all former images featuring women under 18 are now potentially illegal.

UK law

On the 1 May 2004, the definition of a child was altered from a person under the age of 16 years to one under the age of 18 years by section 45(1) of the Sexual Offences Act 2003. The age of a child is ultimately for the jury to determine.

There is a big difference between the Child Pornography laws and the Sexual Consent and Statutory Rape laws. Don't mix the matter up.

I have to agree. I am more comfortable with a person making an informed decision about porn IMHO. I could live with 21 as a rule :2 cents:

That said, we have a lot of performers that are 18 to 20 years old -- that is totally legal -- any ethics aside ... I just hope that they have considered the larger picture.

The age of consent is lower that the age of a legal contract. Since 18 is a LEGAL adult that is the age that they can shoot porn.

Always made me wonder...If a girl was 17 years old and her parents signed for her to shoot...would that be legal?

Playboy did it at least once early on and apparently there was quite the uproar.

If she was a minor, then she was a minor. The pornography now is of her as a minor, I see this as some what illegal to watch or at least anyone watching the content, if having knowledge, then would be watching a minor in porn :2 cents:

For those of us in the industry back during the Traci Lords fiasco, she created a real shit-storm for everyone. I remember it well - as lead video editor for the largest vid retailer in Canada at the time. All her titles had to be pulled from all the stores except the one she was legal.

She went from being the biggest box cover darling - to a pariah.

I think you're right, those making their underage porn clips available to public for profit could be prosecuted for intent to distribute cp. That is if you follow law 'by the book'.

That's what I was thinking also, I was doing some preliminary work for my upcoming project AdultCyberPolice.com and there is a very well known tube site out there right now who has a chunk of full length underage Traci Lords movies on their site. It's threading on dangerous territory there because it's not 1 movie, it's a chunk of them, including other full traci clips also while she was underage. :helpme

The Lords stuff under age 18 is in violation of the law. End of story.

Back in the 80s persons distributing it after it became public knowledge did jail time.

There was a big Federal Court case involving the law as was on the books at the time. It concerned what was then known as 'The mistake of age defense" and how the statue (law) was written.

https://en.wikipedia.org/wiki/United...ent_Video,_Inc.

Curiously, a few years earlier and it would not have been CP.

In 1977 the previous Federal CP law was age 16. FBI and others went to Congress, explained that when they saw some materials in magazines - most coming in from Europe - that they had a hard time determining if the model was a legal 16 or 17 year old, or a well developed 14 or 15 year old. They told Congress to raise the age to 18 - not because 16 and 17 year olds shouldn't do porn, but because it would help them in enforcing the law.

Congress raised the age in early 80s, not much before Lords came on the scene.

Oddly - it was later revealed that the age deal was just an excuse. They just wanted to fight general porn, and again under the most recent President Bush with John Ashcroft as the AG, they tried again - saying it was hard to determine between a legal 18 year old and illegal 16 year old and that age should be raised again to 21. Congress didn't act on the request.
