Some DJs have been confused in the past about carrying membership in performing arts organizations like ASCAP, BMI, and SESAC because the rules differ depending on the performance type. The way their licensing is structured, it is actually the responsibility of the venue (bar, nightclub, etc.) to maintain membership and pay royalties. DJs playing for the public (so not for private events like weddings) then provide a list to the venue of the music that was played ? that?s it. If a DJ plays for the public outside of a licensed establishment, then they are responsible for paying the royalties. This type of copyright licensing has absolutely nothing to do with weddings and private events. Just to be sure, I went straight to the source and asked these organizations directly. Here?s what they said:

?ASCAP does not license DJs. It is the venue, establishment, or promoter of an event that is responsible for public performance licensing, not the performer. Private events such as weddings, etc. are exempt from licensing.?

They (Michael Stipe) have a pretty cool non-profit film company C-100 Film Corp. Does PSAs, docs and maybe features now. I worked on a couple with the other founder, Director, Jim McKay.

All I knew was hearing about it back then that he was being told he couldn't use the song. And then I found out that he still does. So I figured he came to some kind of agreement with whomever owned the rights.

Interesting. I had heard that Stipe especially was getting into film and video production I never knew if it was ever more than just a passing interest though. Sounds like they might be doing some cool stuff.

I know she goes through EMI but I can't believe she never set up publishing on her own.

Unrelated but did you see "October Gales" with Patricia Clarkson and Tim Roth? Shot in Northern Ontario. Amazing landscapes and great film.

The last thing I worked on with Jim was to translate a song in Arabic about a Romeo & Juliet scenario. It was canned cause the ending of the film using it was canned. Great movie. I think it was called Everyday People, for HBO.
