DMCA fine, remove the pics fine, but now trying to get money out of it, fucking hilarious.

I want to shoot back something with law that protects us, anyone know what the deal is with this? I've been DMCA'd a hundred times and always comply, but then they demanding money, gfy!

Any real infos/replies thank you very much :)

Just ignore their emails. They'll go away.

why have stolen content in the first place? If money was made from it, why not lawsuit

jscott 02-15-2016 06:50 AM

Rochard these guys need things explained super simplified. They dont know or cant figure things out on their own.

1. affiliate marketing, we add photos of legal content owned by others, but promoting others sites.

2. sometimes they quit, models "find god" or whatever reasoning.

3. DMCA's are sent

4. content is removed, in compliance with DMCA

5. girl decides to hire lawyers who probably work on commissions to seek money, in damages

6. I did comply with DMCA and always do..... but they now say that removing content is not enough, and that i already broke DMCA law, (i guess because it took me 5 hours to remove it, and they expected quicker?)

go figure

woj 02-15-2016 07:36 AM

fair enough, sounded like something else might be going on...

you should have said what's up in the beginning and avoided the confusion though...
"heads up guys, xyz model found god, and her lawyer is harassing site owners"...

so which model quit? Who is the lawyer pulling this "scam"? ... so we can all pro-actively remove the content and avoid the drama... :thumbsup

Wow, i re-read through this thread... wow SilentKnight, you gotta be the dumbest motherfucker LOL

i was mad before but now i just find it funny lol

let me spell it out for you

content owners give permission to use content, content owners can also remove the right to use that content, thus the DMCA.

if you need another lesson in webmastering i'll have to charge you buddy lol

How much did they ask for for? I would considering paying them, then put them behind bars for blackmailing.

If you get caught "DMCA'd" in your 7/11 store with multiple packs of Marlboros in your pocket you would be 3 x and striken out for life up the "pokey"... Being DCMA'd 100 x is akin to being a thief 100 x over... Stop crying and pay up because otherwise some smart lawyer will get you to cool your heels in jail.

It is simple... Content is king... So buy it,or create it but do not steal it...if you think you will get away with it in the long term move to China or Even better to North Korea.

Why would it be up to content owners to police thieves... Yes we all do but we ar e getting tired of it.

Did you not read the part about legit affiliates having models later down the road send DMCA's because of regret? Do you think that people should be sent to jail for that too or are you just painting a broad brush on everyone and assuming because someone got a DMCA, they automatically stole it?

Interesting figure they come up with. Nobody is going to settle that outside of a courtroom. What's the angle?

so far just barely plausible story has been posted... no name of model involved, no name of lawyer, no name of affiliate program he got the content from, etc...

How hard would it be to post the following?
"look guys, I got content of xxxx model from xxxxx.com affiliate program, now she apparently found god and hired this xxxx lawyer that is harassing me"

everyone would then stfu, the discussion would get directed towards the model... someone would post a pic of her getting gangbanged... we would all have a good laugh... and that would be it... :thumbsup

Do you not understand anything of how our industry works?

Again, it's very simple. He has two options here. He either takes down the content and walks away from it, or he spends the next six months and potential legal fees (have to involve an attorney at some point) trying to determine who legally owns the rights to a picture or video. It's just not worth it. It's not that anyone has done anything wrong, it's just that an affiliate has no way to verify or prove who owns a picture and it's not worth it.

Best case scenario the affiliate contacts the program, and if they are lucky the program responds with a model release form that proves.... Almost nothing. A model release form proves that someone shot the model and has rights to use pictures or video, but you aren't sure for which pictures or which videos, most likely the content owner is the photographer and not the program itself, and you don't know if these rights have been resold or given to someone else.

It's just not worth the effort to fight such things.

Yes I did...the operating quote I have used is: "I have been DMCA'd 100 x"... I doubt that there were 100's of models who found God all of the sudden, and webmasters??? If they are NOT thieves and own the content legally then even a God cannot enable some Model's lawyer to go after anybody... But if you deal with thieves or other shady characters... Or steal stuff directly then you deserve what you get. A nasty lawsuit.

And one more piece of advice...these lawyers will never take it to court ( and I know I have a two of them) but they will file a complaint and the person's real name and a domicile address becomes a public record and then just a phone call to some local reporter will cause the following headline in the local paper: "Mr. XYZ known as a boy scout leader a soccer coach and a member of Our Lady of Roses baptist church has been named as posessing and distributing pornography "..... Sometime worse then paying a couple grand to a skunky lawyer ( formerly known as ambulance chasers):2 cents:

... But that is not my call :thumbsup

why should he? to satisfy gfy's bored mob? he's already stated it's a UGC site (which he didn't need to), pretty simple. There's a ton of reasons legit sites get dmca's, I've had a ton myself over the years, normally over-zealous 3rd parties... easier to just take the content down and fuck the sponsor off as a bad ROI. If I came here and asked the same questions, and had a bunch of gfy armchair lawyers questioning me all they'd get back is a 'fuck off', so jscott has been extremely reasonable in this thread :2 cents:

half the avatars on this site are stolen, I know mine is. gfy should close down because they are 'thieves'? Think that facebook thread here is full of paid/licenced content? This and every forum in existence has tons of copyrighted content on it... that doesn't make the owners thieves - big difference between a forum/ugc site geared towards theft, and one that gets dmca'd... one does not necessarily mean the other, as I'm pretty sure you already know - you aren't one of the clueless :)
