Rochard these guys need things explained super simplified. They dont know or cant figure things out on their own.
1. affiliate marketing, we add photos of legal content owned by others, but promoting others sites. 2. sometimes they quit, models "find god" or whatever reasoning. 3. DMCA's are sent 4. content is removed, in compliance with DMCA 5. girl decides to hire lawyers who probably work on commissions to seek money, in damages 6. I did comply with DMCA and always do..... but they now say that removing content is not enough, and that i already broke DMCA law, (i guess because it took me 5 hours to remove it, and they expected quicker?) go figure |
fair enough, sounded like something else might be going on...
you should have said what's up in the beginning and avoided the confusion though... "heads up guys, xyz model found god, and her lawyer is harassing site owners"... so which model quit? Who is the lawyer pulling this "scam"? ... so we can all pro-actively remove the content and avoid the drama... :thumbsup |

Again, it's very simple. He has two options here. He either takes down the content and walks away from it, or he spends the next six months and potential legal fees (have to involve an attorney at some point) trying to determine who legally owns the rights to a picture or video. It's just not worth it. It's not that anyone has done anything wrong, it's just that an affiliate has no way to verify or prove who owns a picture and it's not worth it. Best case scenario the affiliate contacts the program, and if they are lucky the program responds with a model release form that proves.... Almost nothing. A model release form proves that someone shot the model and has rights to use pictures or video, but you aren't sure for which pictures or which videos, most likely the content owner is the photographer and not the program itself, and you don't know if these rights have been resold or given to someone else. It's just not worth the effort to fight such things. |
