There is no legal side, it was all bullshit to terminate my account and pocket the rebills.

Once they had my domains they just stopped replying. I never received the DMCA copy despite numerous requests. It's been more than 2 weeks now since last correspondence.

but using copyrighted content is no joke... it isn't quite "I'll use whatever I want, then when I get a DMCA notice, I'll take it down"... DMCA only applies in certain pretty narrow cases, it's easiest and cheapest way to get infringing content down, that's why it's most popular...

but when dealing with deep pockets like mr skin, sueing or threatening to sue is 100x better... now mr skin has to pay $750/hr lawyer to prove that DMCA / fair use / etc applies in this case... so no wonder they are a bit displeased...

It was ME who was allegedly using copyrighted content. Not MrSkin.
So if the lawsuit ever came forward it would be ME under fire, not MrSkin.
And the DMCA should have been directed at ME and not MrSkin (like i said, i doubt very much there ever was one).

Anyway, when I was sending them shitloads of traffic they didn't have any problems. They would say "please remove this" or "please remove that". They only got butthurt to the point of closing the account when I stopped sending them traffic and was getting rebills (which they didn't want to pay).

Some have stated MrSkin steals content. Non of us know his deal with the film firms, and I do not think we have the right to ask MrSkin to post hiss business dealings. To be honest its not of any of your business. Promote MrSkin or not, its up to you. I do and I get sales.

Lets be honest, IF he was stealing the film firms would have shut him down and sued him for Zillions. it sounds like you were using domain confusingly similar to mrskin, for example mrskinblog.com, full of mrskin links, banners, etc on it... the copyright holder probably assumed mrskin owns it, that's why mrskin is taking heat, not you...

also, if lawsuit came forward, it would be mrskin under fire, they are indirectly participating in all this and making money from it, plus they are the ones with $$$, not you... it would be pointless to sue you...

based on what you said it sounds like they are taking heat, and so they need to throw someone under the bus to legally protect themselves: "that was an affiliate, we shut down his account, sorry"...

I've been in New York for Affiliate Summit and just finally have had time to address this...

This will be my one reply to this thread. I'll provide the facts and our perspective on the matter and the fine people of GFY can make their own decisions. I think our 17 years in business and stellar reputation with affiliates speaks for itself. Do some digging in the GFY archives and see what you find.

We were implicated in a copyright infringement claim due to the OP using glamour photography of celebs to promote MrSkin.com. To clarify, it wasn?t a DMCA notice, but a straight cease and desist letter from the photographer?s lawyer (DMCA notices are only for user-generated content). On his site, as you can see in the screenshot below, the OP was (and still is) insinuating that we had scanned photographs on our site which we don't. We only post screencaps and clips from film and television. He is also using our trademark on these pages, giving the impression that we own the website. Both of these actions clearly violate our terms.

Once we dug into his account we also found out that he was sending traffic from domains which contained our trademark which is another blatant violation of our terms. As anyone who runs a large affiliate program knows, it's nearly impossibly to monitor every referring url which is why we weren't aware of these issues previously.

The OP did transfer the domains containing our trademark, obviously hoping to get his account unbanned as has been mentioned in this thread. However, he has failed to remove all infringing content, including on the specific page in question. The link and screenshot below prove that. At this point there is no reason for us to un-ban his account as he's blatantly disregarded our terms, abused our trademark for his profit, cost us legal fees, and since being contacted and banned has done basically nothing to truly rectify the problem.

I assure you that eating the rebills from a webmaster who isn't making a ton of new sales is most definitely "a reason" and not an uncommon one. It's happened to me many times as programs start feeling a cash crunch due to declining sales.
