Once they had my domains they just stopped replying. I never received the DMCA copy despite numerous requests. It's been more than 2 weeks now since last correspondence. |

without knowing the url it's impossible to know what actually happened here... but using copyrighted content is no joke... it isn't quite "I'll use whatever I want, then when I get a DMCA notice, I'll take it down"... DMCA only applies in certain pretty narrow cases, it's easiest and cheapest way to get infringing content down, that's why it's most popular... but when dealing with deep pockets like mr skin, sueing or threatening to sue is 100x better... now mr skin has to pay $750/hr lawyer to prove that DMCA / fair use / etc applies in this case... so no wonder they are a bit displeased... |

It was ME who was allegedly using copyrighted content. Not MrSkin. So if the lawsuit ever came forward it would be ME under fire, not MrSkin. And the DMCA should have been directed at ME and not MrSkin (like i said, i doubt very much there ever was one). They even got this covered in their terms, that in any possible event the affiliate takes all blame: http://i.imgur.com/0vZZKS3.png https://www.mrskincash.com/terms Anyway, when I was sending them shitloads of traffic they didn't have any problems. They would say "please remove this" or "please remove that". They only got butthurt to the point of closing the account when I stopped sending them traffic and was getting rebills (which they didn't want to pay). |
Can people stop jumping to conclusions.
Some have stated MrSkin steals content. Non of us know his deal with the film firms, and I do not think we have the right to ask MrSkin to post hiss business dealings. To be honest its not of any of your business. Promote MrSkin or not, its up to you. I do and I get sales. Just because you may or may not promote MrSkin does not give you the right to talk about how he does business with film firms. Lets be honest, IF he was stealing the film firms would have shut him down and sued him for Zillions. Lets put it this was in Leeds a pizza owner many years ago had a pizza joint named after his favorite film. They made him change the name. So if they can find a tiny pizza shop in the middle of no place (and that was before the internet so they were not googling his name) I am more than sure the know about MrSkin. For all we know MrSkin may pay a licence fee, or its just great publicity for the film firms. But its none of our business. But as for Vano. I cannot be bothered to read your posts. BUT...... This is a BIG BUT.... If you have misused pics or vids or a domain name from a film star, then to be honest you bloody stupid and no wonder your account on MrSkin was shut. Do you think they are going to risk upsetting film firms are film stars who provide him/his site with content just to keep you happy? Of course not. If I was running a business and my best mate or a family member was working for me, but I found out they were being a prat and put the business at risk, I would get rid. You just cannot risk things. Also in your first post you stated it had MrSkin in your domain name!!!! That's rule 1 of promoting any site is you DO NOT USE there domain name in any way. That alone would get your account shut. If you had done that with playboy, I suspect not only your account shut but you would be sued too. If I was MrSkin, I would be showing his lawyers your post and see if there were grounds to sue you for slander. If I was you I would think carefully before you post any more about MrSkin. |

also, if lawsuit came forward, it would be mrskin under fire, they are indirectly participating in all this and making money from it, plus they are the ones with $$$, not you... it would be pointless to sue you... |

Also, I already pointed out their terms. Affiliate is always to blame no matter what. |

Your jumping to conclusions. The film company or whoever may have for all you know contacted MrSkin and stated they were not happy. But as I say, if I was advising you, I would be saying that posting in a public forum that MrSkin are 'scumbags' and everything else you have stated they are (I presume they have your name and address on file too), is probably not a good idea. Its one thing to ask us if we think you broke the rules or not, and if your account should be closed, but its another to post that the firm MrSkin is this and that. As I say, I would think hard about your next posts. |

Do you know how quick a film or TV firm can sue and get a site shut down. And there is a difference between porn and film firms. One has millions of pounds to sue you and the other tends not to have. |

Go harass Gary or something. This thread is clearly beyond your comprehension. |
Vano, just move on.
You made some money (great). You fucked up by using MrSkin in a domain name (very few sites will let you do that), and your account was shut (again most firms would close your account and demand the domain name in that situation). This feels like 2001, as I read the same stuff back then. Almost each year something like this. |

I am the one who was so stupid as to use MrSkin in a domain name and think I could get away with it, then when found out and account shut, cried on gfy.com. Oh, right. That was you, not me. I am the one who promotes MrSkin correctly and enjoys the re-bills. Sucks to be you. |
woj: another point is that they shut my account down because i didn't exclusively use their äpproved" content.
Yet, they don't have any problems spamming high-traffic celebrity websites asking to join their program. Here's a screenshot from when they spammed one of my websites: http://i.imgur.com/77gT7dE.png Quote:

I am off now to have a bath in all the money I have made from MrSkin, and still make. I end up not knowing what to do with all this cash as you get so much of it from MrSkin. As you say I am a retard, but this retard still has his MrSkin account. As I say, sucks to be you. |
How much were the rebills worth?

based on what you said it sounds like they are taking heat, and so they need to throw someone under the bus to legally protect themselves: "that was an affiliate, we shut down his account, sorry"... hopefully you can get this issue resolved with them though... |

This will be my one reply to this thread. I'll provide the facts and our perspective on the matter and the fine people of GFY can make their own decisions. I think our 17 years in business and stellar reputation with affiliates speaks for itself. Do some digging in the GFY archives and see what you find. We were implicated in a copyright infringement claim due to the OP using glamour photography of celebs to promote MrSkin.com. To clarify, it wasn?t a DMCA notice, but a straight cease and desist letter from the photographer?s lawyer (DMCA notices are only for user-generated content). On his site, as you can see in the screenshot below, the OP was (and still is) insinuating that we had scanned photographs on our site which we don't. We only post screencaps and clips from film and television. He is also using our trademark on these pages, giving the impression that we own the website. Both of these actions clearly violate our terms. Once we dug into his account we also found out that he was sending traffic from domains which contained our trademark which is another blatant violation of our terms. As anyone who runs a large affiliate program knows, it's nearly impossibly to monitor every referring url which is why we weren't aware of these issues previously. The OP did transfer the domains containing our trademark, obviously hoping to get his account unbanned as has been mentioned in this thread. However, he has failed to remove all infringing content, including on the specific page in question. The link and screenshot below prove that. At this point there is no reason for us to un-ban his account as he's blatantly disregarded our terms, abused our trademark for his profit, cost us legal fees, and since being contacted and banned has done basically nothing to truly rectify the problem. If any affiliates would like any other questions answered, feel free to contact me or any of our representatives directly. We are always available and happy to help.
