The ATF and DOJ made a determination in 2010 that they were not illegal under the current law. They did not negate law or make law. They can't do their job and prosecute a law that does not exist.
Meaning if someone wanted to make a law, they could. But they could not prosecute under existing laws. Since they were not a firearm, they were a part. Much as the parts are made and sold to convert a AR-15 to a fully automatic weapon without some crazy contraption, just replace a part. Who will go after those parts ? Probably will not be covered under any legislation we get. MAKING LAWS IS CONGRESSIONAL WORK ! as per the constitution - read it ! |

As a legal matter,
I'm having a hard time understanding the difference in forcing the allowance of a firearm sale to the mentally deranged but a legal citizen, and prohibiting selling beer or cigarettes to a legal citizen 18 - 21 years old who is not mentally deranged. One or both of these is wrong if we are to have equal treatment under the law and it is enforced under the same principles to all people. The point is we do discriminate when it comes to health and safety but not equally. And the federal government has the ability to regulate interstate commerce. So said the Supreme Court. |

Whether you like it or not (many do not) the 2nd Amendment guarantees a citizen's right to posses firearms -- the courts have made lots of precedence of this. There is no constitutional right for ordinary civilians (not in the military (or state militia)) to possess certain weapons that can be used in warfare or mass killings. Congress can legislate reasonable gun control laws that ARE constitutional, Presidents can sign the bills into law, and if constitutional, the courts will uphold the law. That is the way it works -- politics aside. Alcohol and Cigarettes kill a LOT more people than guns do. But in America you can self-destruct legally like everywhere in the world. And the Government has the right to regulate commerce and discriminate on risk. The 'bill of rights' has more than one part to it. I suggest you read it all. And the constitution gives plenty of right's until they infringe on the rights of others. So they always have been a 'within limitations' type of rights. Nothing 'meaningful' will be done on this issue till many more people die and we all have plenty more stupid arguments once again. Because that's where the money is on it. It's a political tool for power at present. That's all. But I fear boycotts and other social disruptions until something meaningful is done. Could get very messy if there is a copy cat shooting soon ! But I hate to see it and I know somehow it's coming. Funny how all those that talk constitution on 2nd amendment get pretty wound-up when a black guy exercises his right of dissent, and kneels during the national anthem, and he only does this for reasons to draw attention to others that the constitution has been ignoring. Somehow forgotten. Go Figure ! I guess it says that they do not want to stand-up for all of the bill of rights and not for eveyone. And that is un-American. |
