As then there's a "loophole" that'll fix this almost immediately for you. I've had numerous issues with PayPal over the years but it's quickly solved because in California, and with PayPal being in California, the arbitration clause isn't legally binding. California residents can't legally sign away their right to a lawsuit. So you start with a demand letter, explaining that you know your rights, are well aware the arbitration clause isn't binding, and the letter you're sending isn't a threat but is required under California law as defined in paragraph 6 of subdivision (a) of section 55.52 of California civil code, and you know it's illegal to send the demand letter without actual intent to sue. Print it, send the letter via USPS signature required to PayPal. You'll get a call and the money real quick, as they at that point know you actually mean business and it's FAR more hassle for them to defend the lawsuit vs just releasing the funds. The "trick" to any of this is you actually need to say the right stuff because right now you don't even have a case, 2000 people or just you makes no difference, as you signed the agreement that says they can do this. They know you won't win on that basis, so you have to bring up something else such as 'unjust enrichment by gaining interest off the held funds that isn't paid out to the customer after 180 days'. That's exactly what I used as an argument, outlining that the user agreement says they can hold my money but my case is based upon them making interest on the funds without payout. They folded immediately knowing that is a legit legal claim against them that they don't want going to court because if I win they'll have to pay out interest. |
