Thanks for the feedback Aaron. :)

I just ordered my first exclusive set earlier today (kinda excited about it, hehe), but it's for a paysite. I've just always wanted to know if it was worth it to buy for anything other than paysite use.

I guess it depends on how much you pay for it and how good the content is. If you pay alot of money for a boring set or use it for the wrong niche, I'd imagine there's no saving you. Hehe.

The upside is that the smart paysite owners will notice this and then contact the content provider and start buying exclusive sets as well.

Trust me...It happens more than you might think.

Unless the Paysite owner is a cheap bastard....Right triumph?

Glad to be of assistance. :)

If you are smart enough to buy exclusive then one would hope that you are smart enough to know where and when to use it.

Yes its fixed. How's this www.heatherhamptons.com/legal.html

Is that ok?

Sorry but your 2257 information is absolutely non-compliant. You need to post the name of the Custodian of records.. a PHYSICAL address where the records are kept. It needs to be an address where someone is available during normal weekday hours. P.O. Boxes etc DO NOT comply. The custodian of records must be DIRECTLY associated with your company. Not a lawyer, or someone who has nothing to do but hold records... There are other issues but those are some of the biggies.... I suggest you get yourself compliant, or you are putting yourself and anyone who purchases your content at serious legal risk.

Yup, or if your tricky you could license the set to the paysite and lower you costs some more (pending your exclusive agreement).

LadyMischief 10-21-2003 04:51 PM

And regarding hosted galleries... even some content providers that DO NOT allow the content to be used for hosted galleries will allow you to pay extra as a sort of compensation fee, and then allow the content set for use. Generally that set is pulled from the site thereafter. There's no harm in actually ASKING those who don't have hosted galleries allowable in their standard license if they can make such a deal.

That's something you have to take into consideration when you take on the responsibility... Unfortunately, the law doesn't make allowances for that kind of privacy if you are the custodian :(

You remove them from the site if it is content covered by the 2257 rules.

Maybe we should lobby the government to change that law. I think it is reasonable to have a P.O. Box listed, but put in the law that if a request is made by a government agency for legitimate purposes to see your documents and you don't respond in a resonable amount of time then they could subpoena your real address from the Post Office. I know the government doesn't exactly like adult webmasters, but certainly something could be done. Is an amateur model going to have to be harmed by someone who found her address on the 2257 page of her site before anything is done? :(

Tough shit. They are in the wrong business.

Harsh but true.

tootie 10-21-2003 05:18 PM

I think content providers having to display their business addresses is one thing. It's not nearly as likely that someone would start to stalk the photographer or broker of a model than it is to think that an amateur model who has her home address on her website might be stalked by an obsessed fanatic. Individual models who pose nude being forced to display their home addresses like that is just plain wrong. :(

That, by the way, is the only hurdle forcing me to buy exclusive sets instead of shooting them myself. Good news for the photographers, bad news for me. LOL

It's wrong but neccessary.. We display ours in our custodial information. Fortunately our address is obscure, however, it's still the law, however unfair.

This topic has been beat to death and ALL angles and opinions have been covered. None of what has been said has made any impact on the law. If you feel strongly enough about it, stop bitching and do something to make a difference.
