And before anyone says it is some sort of tax sheltar for us- absolutely not- as a matter of fact, because we are involved, we cannot even deduct all the operating expenses that we cover out of pocket. It's been tough for them since their days of being seen everywhere as one of the adult internets premiere affiliate programs. People like Speakthetruth still try and give little jabs about the Microsoft allegations and discredit the genius behind a program that actually invented something great for our industry. Appearantly M$ didn't have an overwhelmingly convincing case if it's been settled so quickly. If they had a great case against them, it would have been stretched out for several more years and a loss of millions of dollars. So, let's not try to poke holes in the matter at hand. Being a hater doesn't make you more money, just makes you look like a hater.

Why are people so quick to hate on a patent holder? I would listen to Far-L and FightThePatent's opinions over 99% of the people in this thread and they seem to think XPays invented something. Most people won't need to worry about this patent unless an infringer doesn't license their patent. Then that infringer puts their affiliates and business partners at risk. So if you feel a certain program is infringing, don't yell at Evan, go talk to the program in question and ask them their views on this and what their plans are to resolve these issues.

Evan needs more of a pat on the back then a slap across his face.

Most of us were too lazy to read and actually attempt comprehend the patent. Now that fightthepatent and others have translated it for us it is starting to make sense. Evan and Mike patented what they worked hard to create. Can't have any hate towards that. Congrats. :thumbsup

There are alot of mainstream companies doing the virtual affiliate thing. housewinnings.com eventually leads to http://www.quinstreet.com/ for the company that does the actual marketplace work.

Most of them started doing business well past May 1999, so they all could be under the targets of Xpays' patent.

A poster put up earlier some mainstream companies that they felt were prior art... if there is prior art, then the patent should be invalidated. If there is no prior art, then the patent holds up to the USPTO's awarding of the patent.

Any patent holder should welcome prior art scrutiny.. of course Acacia said this, and they got what they asked for.. lots of prior art.... :Graucho (many thanks to people like Gateway and Squirt who came up with some great finds along with my own research, to present the prior art finds to over 2 dozen defense patent firms, including one major cable company).

i will be frank on this one- we were cheap bastards who did not want to pay $1 per email address like EVERYONE else was. The good thing is that companies have earned substantially more on their X2U addresses than $1 per raw address.

They launched I believe like a year later than X2U with their upsell bonus, as did CE and Join4Free. All were after. I saved their announcement emails even :thumbsup
