an offence punishable on summary conviction.

Every person who imports, distributes, sells or possesses for the purpose of distribution or sale any child pornography is guilty of

an indictable offence and liable to imprisonment for a term not exceeding ten years; or

an offence punishable on summary conviction.

Every person who possesses any child pornography is guilty of

an indictable offence and liable to imprisonment for a term not exceeding five years; or

an offence punishable on summary conviction.

It is not a defense to a charge under subsection (2) in respect of a visual representation that the accused believed that a person shown in the representation that is alleged to constitute child pornography was or was depicted as being eighteen years of age or more unless the accused took all reasonable steps to ascertain the age of that person and took all reasonable steps to ensure that, where the person was eighteen years of age or more, the representation did not depict that person as being under the age of eighteen years.



Where the accused is charged with an offence under subsection (2), (3), or (4), the court shall find the accused not guilty if the representation or written material that is alleged to constitute child pornography has artistic merit or an educational, scientific or medical purpose.


Subsections 163(3) to (5) apply, with such modifications as the circumstances require, with respect to an offence under subsection (2), (3) or (4). [1993, c.46, s.2.]

Actually John, the Russian thing probably isn't illegal. Canadian laws require that sexual organs of the child be visible for it to be Child Porn. It doesn't mention secondary sexual organs (breasts) specifically. I'm not talking about your Russian girl with the bottle of Vodka.

The definition of what is and is not CP in Canada is pretty strict. Such that a picture of a naked child is not by definition child porn.

The Child must be involved in a sexual act with sexual ograns visible. In reality, the russian girl probably doesn't qualify.

Posting a link to hardcore CP on GFY is a matter of black and white. He admits doing it and says he did it in "anger" but then also calls it a typo. You don't typo a link and anger is not legal defense.

Child Pornography on the Internet: These new offences each have a maximum penalty of 10 years imprisonment and make it a crime to:

I've bolded sections that apply specifically to John. We know he "made available" child porn. He posted a link. This is clearly a violation. When I asked John why he was at that site in the first place, his response was (paraphrased) "I am doing sexual research and getting these sites shut down.
