No way, he was still moving and had a loaded weapon. Sure A poor guy with a public defender would probably do time for this if it happened in the projects. In a nicer neighborhood, a white guy with any half decent lawyer wouldn't even be taken to trial, he'd get a pat on the back from the cops.

I hate to start throwing out credentials (because I truly lack them) but I have a BA and was Pre-Law, accepted into Law School. Was a intern at a DA's office for 3 years undergrad. I know murder like the back of my hand.....

If that video was real that guy would be going to jail. One Shot...One Kill....justifiable homicide (self defense). One shot and the guy is still standing with the gun aimed at you... justifiable homicide.

One shot and the guy goes down....you get the fuck out of there and call the cops. The second shot would have been arguable in court by a good defense attorney. The third one gets you a sentence and a jailhouse nickname.

ah if only you could get away with that in REAL life

I still say it depends..and it's something I would be willing to risk.
I'm not saying that the by the letter of the law you would not be charged....what I am saying is I don't think you'd get convicted by a jury.
You could argue a variety of issues here and anyone of them I think would cause a jury to consider whether they want to send a man who was in complete fear of his life 1 second before to jail because he continued to shoot after the guy was down when the law feels as though he should be rational and consider his options and get out.

True, just a big risk, you know how the court system works sometimes, maybe if you have money like OJ for some big time lawyers, you would be fine :)

I personally would have found that security cam and removed that tape or something. :)
