Wow I just was thinking about that claim the other day, thanks for Posting this. It's pretty enlightening in terms of the ruling based on personal Jurisdiction limitations.

Fuck you. You should be paying him for the advice. Everyone here always thinks that other companies should pay for their problems; when is the last time you did one good thing for the industry or any company or even any individual?

countersuing and all the huffery will not sit well imho and this example is a good example of what happens when illegitimate affiliate ads get promoted by legitimate affiliates. the legit get sued while the illegit hideaway in distant locations :2 cents:

there were no releases on the allison williams video and it harmed her reputation. a lot of you cry about my legal rantings about content and the misnomer "public domain" and now you see reality. i am looking out for your best interests.

this case is not a joke for those caught in the cross-hairs and one should not assume that because a sponsor publishes pics or vid's that the sponsor is setup legit. greed gets you a couple quick dollars- then reality comes to take it all back and then some.

</rant>

I'd agree 100% with this.. I'd bet the samething could very likely happen with all these un-licenced girlfriend sites.. When the wrong daddy finds his daughters pictures on some website, the affiliates are going to be the ones that pay. Not the programs sit off in some hideaway.

You'd just get arrested, sued and prosecuted as "John Doe".
Fake whois will not protect you, it just makes it take longer to find
you and adds to your guilt when the jury hears you used fake names and
addresses because you knew you were operating outside the law.

That is not entirely correct.

Take out the arrested and prosecuted and add an "if" before the getting sued point and you are getting pretty close though.

Yep, file this under "little things you can do in life to make things a whole lot easier"...

Robbie 01-20-2009 04:43 PM

Hey guys...did you miss that the thing was dismissed? You're dramatizing over something that doesn't matter. :) No affiliates were sent to jail. No affiliates were harmed at all. And no program sitting off in some "hideaway" has been sent to jail either. It's okay. No need to be scared anymore. lol

There is plenty of worthy information about what people need to be watching out for. Wasn't the first and won't be the last of this kind of lawsuit.

Exactly. That's why I won. I had legal counsel.

Dr.Strangelove 02-10-2011 05:41 AM

She won an appeal the other day to enter default judgements against 28 defendants who did not respond to the complaint. She was also awarded 7.9 million against 9 defendants in '09.

Whois means nothing when it comes to court... First you have to pay for them, and you have to host them, and you login to manage them on an IP. It's VERY easy to request that information, it's VERY easy to track people down online.

TheDoc 02-10-2011 06:03 AM

This lady is nuts btw... Besides already losing some cases, now she is getting counter sued and will lose again, and couldn't collect shit even if she tried.

Sad anyone had to waste time with lawyer costs on this crap... she deserves to be counter sued until she is broke.
