How would Google have found the url if it was never public though? If someone had a link to it and that page was in Google and the spider crawled through the links, then its no longer private, but this wasn't the case.

I disagree with that. If its not published anywhere (ie: not findable through a public resource such as Google or other site), then I tend to think its private.

Is there any legal cases or presedences regarding this type of issue that anyone knows of? Certainly poses an interesting topic if anybody has litigated over private links like this.

Hacking someone is breaking in. Accusing someone of hacking when all they did was post an open link is liable IMO. I believe (my opinion only here), that once the url is posted in a public area (such as a webpage which is searchable by Google for example), its now public information. Whether or not these urls were public knowledge before fris' post is the interesting part.
