But is the image actually copyrighted?
Just taking a photo of lets say my dog, and posting it on a website, does that actually make it copywritten?

How does Gigacash get away with using images of Kiss in their webmaster banner on this board?
To me, those likenesses would actually be copywritten.

How would Google have found the url if it was never public though? If someone had a link to it and that page was in Google and the spider crawled through the links, then its no longer private, but this wasn't the case.

but what if google spiders it? IS google liable because you didn't have a link to that page on your public site?

It's like leaving your window open in your house, IF you dont want people to stand on the sidewalk and peak in then you should shut your curtains. It certainly is not a hack. Hacking someone is breaking in. Accusing someone of hacking when all they did was post an open link is liable IMO. I am not the sueing type but i would counter sue someone's ass off if I was in Fris' position.

I believe (my opinion only here), that once the url is posted in a public area (such as a webpage which is searchable by Google for example), its now public information. Whether or not these urls were public knowledge before fris' post is the interesting part.
