Check out the "total online" numberss on the left of each one...

whether cams-com's numbers are bogus or not...they make cams.com look real weak in the eyes of the common surfer. Bad to say...but the common surfer is going to stay where the most online is.

Rip the website a new one and take everything!

KRL 09-02-2005 10:20 AM

Copyright infringement aside, this thread is tacky and totally unprofessional.

Lars, your thread title would imply that iFriends is directly stealing your material, your branding, and so on. A closer look shows that one of iFriends affiliates has taken liberties with your materials...and not iFriends themselves.

So, your attempt at drama to discredit iFriends has worked, but at the same time, iFriends could be equally justified at screaming back at you for this blatant slander.

I'm always amazed at how the industry leaders in this industry don't seem to have 2 bits of business sense to rub together.

This thread is about copyright infringement so it kind of hard to say "copyright infringement aside"

Kind of like saying " aside from the mass killings , hitler was a good guy "

I dont think the thread was intended to slam ifriends , i certainly didn't get that from the thread.

Lars choice of words may not have been the friendliest , but in no way is it "blatant slander"

Demanding something isn't slander, you may not get what you want , but it certainly isn't slander ( besides slander is spoken , libel is written )

He is simply warning them in no uncertain terms that they are now aware of profiting from stolen content and need to stop it.

Chaldoray 09-02-2005 11:52 AM

bumpppppp

Chimmy 09-02-2005 12:00 PM

First. Coyright aside is a valid comment. This implies that I agree that there is copyright infringement. That is not my point...so I am simply deflecting all of the the flames about how serious copyright infringement is. (But judging from your response, this attempt was a failed one).

And on to the other points. The title does slam iFriends. It doesn't say "Webmaster infringes on our copyright"..it doesn't say " Someone is stealing our material". It does say "iFriends better get this turned off".

Libel, slander..whatever...my point remains. What is accepted as a normal way of doing business in this industry wouldn't fly for a second in the "real" business world.

This thread is about copyright infringement, if you set it aside there is nothing to discuss..

see example about hitler being a nice guy ( if you put the mass killings aside )

And ifriends better get it turned off or they will be liable as far as i see. I dont see why that is hard to understand or would be "slamming". Its not a threat , its a wise piece of legal advice i would think..

Actually your exact words were "blatant slander", theres no "point" , he either did do blatant slander ( and its quite obvious merely from the dictionary results , that he did nothing of the sort ) or he didn't . And what he said in the title doesn't qualify as slander or libel.

But you are right this wouldn't be accepted in the "real world" , ifriends would be slapped with a c&d and so would the host and owner of the site in question. ( and possibly you for falsely accusing someone of slander :winkwink: *but since its written it you would be charged with libel)

Not raining on your parade, he might have gone about it the wrong way because he is pissed , but nothing illegal about that.. might be a bad business decision in your opinion , others might find it a good one.

Chimmy 09-02-2005 04:37 PM

Nope...disagree. This is not an iFriends issue. This is an iFriends affiliate issue. Same as if a teenager broke a car window with a hammer he bought at Walmart. It's the teenager that is at fault. Walmart has nothing to do with it. So, for a competitor of Walmart to try and muddy up the name of Walmart by blaming them would be irresponsible and foolish. (ie. Lars vs ifriends)

Have a nice day.

u-Bob 09-02-2005 04:39 PM

Nice example , but not even close..

Ifriends is not culpible until they are notified..

Why make an example so far off base , lets make it more realistic..

If mcdonalds hired a company to make burger flyers to hand out infront of their restaurants and unbeknownst to them , the company that made the flyers simply copied the burger king flyer and crossed out "burger king" and inserted "mcdonalds"

While mcdonalds wouldnt be laible , if they were informed of the thievery and didn't take action ( i.e. stopped handing out the flyers , they would be )

And in such a case i wouldn't find it at all strange for burger king to write an editorial entitled " MCDONALDS BETTER GEt THIS TURNED OFF ASAP" even though mcdonalds didnt make the flyer ,furthermore they wouldn't be out of their legal right to say such a statement..

* I'm having a nice day thanks

I'm not going to take the time to look it up .... but i believe that walmart was sued by a few people for selling guns that killed family members .... don't recall if any of them won there case ...

I wonder if that guy was is an affiliate of cams.com & built that page to promote your site, then swapped out the links to see if IFriends converts better.

Obviously still not cool using cams.com copyrighted material, but just trying to figure out what he may have been thinking.

Smokey, my man.

Slander and defamation are both libellous acts.

Slander is spoken.
Defamation is written.

Libel is causing harm to an entity's reputation.

Now that that's cool- let's continue :)

Damn, straight jacked.
It's too easy to click save. Maybe we should all put unique hidden tags that google picks up on... this way we can find out stolen pages.
