This is not as simple as trying to maintain a good position or market share in a niche. A branding infringement is apparent. It is highly unlikely they weren't aware of <i>Club Seventeen</i> before they designed, named and marketed such a site. If they weren't, that is one handsome coincidence.

As I said, this is a branding infringement, NOT a product infringement.
As far as Froot Loops go, I find it hard to believe they didn't go crying. In fact...in this case, they <b>did</b>. Kellogg's pursued a drum band named <i>The Toucans</i> for using the same bird in their name as Froot Loops feature in it's marketing - Toucan Sam.

just a quick note to all who put the banners were very different...

1) there are 2 girls, both in the same pose, both with clothes in the same position, both looking at the same angle
2) both mention dutch/holland
3) both say seventeen somewhere on the banner

.. and yes... 4) they are both vertical! ;)

i think they do have a case, but dont think they would win..

not worth the effort.

i strongly recommend they dont mention the other site on theirs though, or in their members area "these ppl are ripping us off". if i was a member, id check them out to see how much they were ripping off, with the chance i might like it and switch!
