I thought that members of the FSC can't be searched until a ruling on 2257 is reached?

the 20 hour per week deal is part of the new regs - if they are visiting as per the old 2257, i believe it is all business hours.

Inspections shall take place during the producer's normal
business hours and at such places as specified in Sec. 75.4. For the purpose of this part, ``normal business hours'' are from 9 a.m. to 5 p.m., local time, Monday through Friday, or any other time during which the producer is actually conducting business relating to producing depiction of actual
sexually explicit conduct. To the extent that the producer does not maintain at least 20 normal business hours per week, producers must provide notice to the inspecting agency of the hours during which records will be available for inspection, which in no case may be less
than twenty (20) hours per week.

Which is a real burden for single person companies. Small sites, photographers, etc. Vacations, out of town shoots ...... ?

Here's clarification on this point, from a press release issued a few minutes ago by the FSC:

2257 Inspections Have Begun!

Chatsworth, Ca. ? The Free Speech Coalition (FSC) has learned that the Federal Government has initiated the first of the long-awaited 2257 inspections. Five FBI agents today checked the records of a major (primary) producer of adult content for specific movies, used their own copying equipment and left the location.

FSC urges you to check with your own attorney.

If you are a primary producer or a primary and a "secondary" producer, expect an inspection. If you are in the latter category and are also a member of the Free Speech Coalition, only the primary producer records are subject to inspection.

If you are exclusively a ?secondary? producer, or both primary and ?secondary,? and exempt from ?secondary? inspection by virtue of your Free Speech Coalition membership, it is important that you ask your lawyer how to decline the Federal inspection, and notify the FSC office as soon as possible if such an inspection is attempted.

2257 is only about record requirement. There are other laws they can use :2 cents:

Story Updated.......

http://www.avn.com/index.php?Primary...tent_ID=272407

Allan said the FBI did not disclose the other names on the list, but knowledgeable sources say that the agents are interested in examining the records of 23 video titles from various producers. That list was not made available to AVN.com.

It's the current deal right now for secondary producers...primary is open for inspection at any time.

This is a good thing. They should check the records. If the companies aren't using underage models they should have nothing to hide. In fact, I would not be against manditory anual inspections of all producers 2257 records. Reasonable regulation is good for our industry. We should have nothing to hide. As the owner of Diabolic said, they are being professional about it and are just there to check records, they're not on a which hunt.

That beats the hell out of having a bunch of FBI agents kick in the door and size all computers and other property because some religious nut makes a fake complaint.

XPays 07-24-2006 05:29 PM

based on the update from avn it seems like they were after specific title doc's and not every movie in one's portfolio. my guess is they know something about a model and this is not random. they held out and will now look for some low-hanging fruit...

If so, that is the way it should work. Checking out specific models. And I can see wanting all files in order so they can check and leave.

You are missing my point.

Wouldn't it be nice if inspections are based on SPECIFIC content. NOT every piece of paperwork in the fucking building.

This would mean inspections to keep underage models from being used is the agenda. Not, let's harass the industry.

RawAlex 07-24-2006 11:30 PM

Okay, my quick take from over here:

if they are looking at 23 specific videos, they may be looking at either (1) a specific performer or group of performers, or (2) a specific type of video.

It would be very interested to see after the 2nd and 3rd companies get visited to see what it is they are looking at and such. It would be a big issue if the FBI discovered a potentially underage performer or something like that, and they are trying to see who all used that performer. (PLEASE! THIS IS NOT EVEN SPECULATION ABOUT ANYONE... JUST A THOUGHT, NOTHING MORE!)

I guess more news in the morning, right?

Conversely, it will only take ONE company not having all their ducks in a row to fuck us.

seems harsh, but at least they were nice about it :thumbsup

Mutt 07-25-2006 05:26 AM

if they knocking on the doors of companies who shot a specific model who they know was underage when she was shot then this is even a bigger waste of taxpayers money - nobody in LA shoots an underage girl on purpose - occassionally like in the Traci Lords case a girl gets through with great fake ID's that nobody even suspects are fake - nobody who shot Traci Lords was charged because they couldn't and still can't put the onus on a producer to prove the ID's a performer presents are bonafide.

they should be going after YouTube and myspace - those are the two largest child pornographers on the planet now - go knock on YouTubes door and ask them if they have ANY ID's let alone valid ones on the underage teens on their sites.

DWB 07-25-2006 07:10 AM

Looking at Diabolic or any other major DVD companies is a waste of time. If they want convictions they need to look no further than many smaller web companies. I know a lot of you are on the up and up, but lets be honest... how many amateur sites out there do you think follow the rules?

Though it does sound like they may be looking for info on that one underage black model. Lets hope that is the case and it ends there.

The good thing is

if they find that this model is underage everyone that has her online will know where she is online so they can remove her immediatly.

Thats an advantage of having your records in order you know where she is with one quick search of your database.

BINGO.

The state of California issued her a valid license with a fake birthdate.

RawAlex 07-25-2006 11:18 AM

I am actually very happy if the hit 10 DVD companies (major producers) and find that all the records are in order. Then the FBI will go back in front of congress and be forced to say "there is no evidence that anyone in the mainstream adult buisness is using underage models or lying about model ages. It must be those fucking pedos filiming their 8 year old daughters fucking a dog that are doing it, but we are not sure!"
