Did the stipulation that if you're a FSC member, that they can't come after you? I thought that was the deal.
|
An annual "reporting/inspection" day would be nice. Hope the companies on the list don't have any meetings, interviews, shoots, or other important LEGITIMATE business activites planed for the day. Interruptions suck, esp. if they can be avoided. :2 cents:
|
we've got nothing to fear, but it would suck to have them come and knock on our door... oh, wait! they don't operate outside the US, so I doubt they will send an agent here to check our paperwork (we do have it, just in case).

inspections shall not be given. Inspections shall take place during the producer's normal business hours and at such places as specified in Sec. 75.4. For the purpose of this part, ``normal business hours'' are from 9 a.m. to 5 p.m., local time, Monday through Friday, or any other time during which the producer is actually conducting business relating to producing depiction of actual sexually explicit conduct. To the extent that the producer does not maintain at least 20 normal business hours per week, producers must provide notice to the inspecting agency of the hours during which records will be available for inspection, which in no case may be less than twenty (20) hours per week. |
Like I said :)
- I know plenty mid-level primary producers/companies that are in the office 60 hours one week and not at all the next. It's one thing for the big boys with 20 employees and "regular" business hours, but the majority of mid-level companies are less than 5 employees. |
I hope if they show up they dont show up in big black SUVs with FBI jackets on and shit cause all the office neighbors will wonder whats up....

And that is what I should tell the Federal Judge? |
I thought that members of the FSC can't be searched until a ruling on 2257 is reached?

the 20 hour per week deal is part of the new regs - if they are visiting as per the old 2257, i believe it is all business hours.

********** FOR IMMEDIATE RELEASE Contact: Tom Hymes 818-304-1712 July 24, 2006 2257 Inspections Have Begun! Chatsworth, Ca. ? The Free Speech Coalition (FSC) has learned that the Federal Government has initiated the first of the long-awaited 2257 inspections. Five FBI agents today checked the records of a major (primary) producer of adult content for specific movies, used their own copying equipment and left the location. FSC urges you to check with your own attorney. If you are a primary producer or a primary and a "secondary" producer, expect an inspection. If you are in the latter category and are also a member of the Free Speech Coalition, only the primary producer records are subject to inspection. If you are exclusively a ?secondary? producer, or both primary and ?secondary,? and exempt from ?secondary? inspection by virtue of your Free Speech Coalition membership, it is important that you ask your lawyer how to decline the Federal inspection, and notify the FSC office as soon as possible if such an inspection is attempted. ********** - Q. |

Story Updated.......
http://www.avn.com/index.php?Primary...tent_ID=272407 Allan said the FBI did not disclose the other names on the list, but knowledgeable sources say that the agents are interested in examining the records of 23 video titles from various producers. That list was not made available to AVN.com. |

This is a good thing. They should check the records. If the companies aren't using underage models they should have nothing to hide. In fact, I would not be against manditory anual inspections of all producers 2257 records. Reasonable regulation is good for our industry. We should have nothing to hide. As the owner of Diabolic said, they are being professional about it and are just there to check records, they're not on a which hunt.
That beats the hell out of having a bunch of FBI agents kick in the door and size all computers and other property because some religious nut makes a fake complaint. |
based on the update from avn it seems like they were after specific title doc's and not every movie in one's portfolio. my guess is they know something about a model and this is not random. they held out and will now look for some low-hanging fruit...

If so, that is the way it should work. Checking out specific models. And I can see wanting all files in order so they can check and leave. |

THEN i'll be satisfied. jk . i was just bustin your chops :) |

well if you have all your documents there shouldnt be a problem...
|

And did they want specific content, a particular model or all the records the company had ? Big difference .......... |
Quote:
You are missing my point. Wouldn't it be nice if inspections are based on SPECIFIC content. NOT every piece of paperwork in the fucking building. This would mean inspections to keep underage models from being used is the agenda. Not, let's harass the industry. |
Ouch! Ouch! Ouch :(!

Okay, my quick take from over here:
if they are looking at 23 specific videos, they may be looking at either (1) a specific performer or group of performers, or (2) a specific type of video. It would be very interested to see after the 2nd and 3rd companies get visited to see what it is they are looking at and such. It would be a big issue if the FBI discovered a potentially underage performer or something like that, and they are trying to see who all used that performer. (PLEASE! THIS IS NOT EVEN SPECULATION ABOUT ANYONE... JUST A THOUGHT, NOTHING MORE!) I guess more news in the morning, right? |
