when I read the first thread I immediatly contacted wiseman about it via ICQ to see what was going on

he replied to me in very short time and explained to me the situation

Thats the way biz should be done.

Its a shame this industry has been reduced to slamming people on boards FIRST and not contacting the program first

People.. get real, this faux-drama got posted as an anonymously hosted screenshot at a free image hosting service on a weekend with no affiliate code. We ended up finding the offending affiliate by digging up the member id through the database.

If we had some history of bidding on zango I guess I'd assume the worst too... but I do not believe anybody has ever claimed we buy Zango traffic before.

Finallly... for those of you who like to spout assumptions as though they are facts....QuickBuck does not generate our own traffic and never has. 100% of our traffic is affiliate driven, we don't mail, don't bid on ppc, don't buy gallery spots etc..etc.. etc..

If i were so inclined I could buy traffic to twisty's to pop over the hun... is it Shap's fault if I do that? How would he know if nobody reported it?

I actually made this post back in Feb 2007 about the same problem. It has been going on for a while. n Since QB already termed the affiliate, anyone got some good ideas get the illegal pictures taken down. I know the owner of CarolCox.com gave it a pretty good shot to no avail....

Just found this site using at least two girls content and I suspect all the girls content illegally. There are no watermarks or links back to any of the girls. Who ever this is has gotten themselves up to number 2 or in some cases number 1 on google using the girls name but with a .org (not technically illegal....I guess) But their site is using the girls pictures to link to a site in no way affiliated with said girls. There is no mistake in your findings... the guy who runs all those .net & .org sites of 100's of pornstar and sologirl sites is sending the traffic directly to xxxpass.com which is own and operated by Quickbuck.. the easy solution would be to convince quickbuck to term this affiliate, and I for one would welcome his traffic to the official sites for the models he has these .org & .net sites for. I am open for any other suggestion... the DMCA approach from what I understand is simply a waste of time...

DCMA is not a waste of time - but you have to aim correctly.

1) DMCA the domain owner. This may be useless, but you have to do it, otherwise everything else is meaningless. If the mail in undeliverable, all the better.

2) DMCA the domain host. Again, the mail may or may not be undeliverable, and it may be the same person as step 1. This is an important base to touch none the less.

3) DMCA the IP block holder. This is often different from the host, and sometimes is slightly more successful.

4) DMCA Quick Buck. They are the ones currently monetarizing the traffic, and as such, have both contact with the affiliate in question and the control over the income.

5) DMCA Google and Yahoo. Getting these sites out of the SERPs will greatly reduce the amount of traffic they get. It might not stop the violation entirely, but it will remove the profitability. Make sure that you indicate on your DMCA that you have been told that this owner has many other similar sites of similar design cross linked. Google might squish them all with enough complaints.

6) DMCA Quick Buck's processing company. Again, they have a hand in turning this theft into money, and they have the ability to either make it stop or at least lower it's value to the point that it stops.

If you are truly bored and want to have some fun, DMCA notify Visa in the zone that is processing for these sites. Remember, the implication of all of these sites is that you will find these stars (and potentially this content) inside xxxpass, so there is potential that there is content used without permission / 2257 non-compliant inside the site. Therefore, when in doubt...

Have fun. Remember to send all the mail registered or by courrier requesting signature. Google has a special fax number to send this stuff to, search around on their site to get it.

2) DMCA the domain host. Again, the mail may or may not be undeliverable, and it may be the same person as step 1. This is an important base to touch none the less.

3) DMCA the IP block holder. This is often different from the host, and sometimes is slightly more successful.

4) DMCA Quick Buck. They are the ones currently monetarizing the traffic, and as such, have both contact with the affiliate in question and the control over the income.

5) DMCA Google and Yahoo. Getting these sites out of the SERPs will greatly reduce the amount of traffic they get. It might not stop the violation entirely, but it will remove the profitability. Make sure that you indicate on your DMCA that you have been told that this owner has many other similar sites of similar design cross linked. Google might squish them all with enough complaints.

6) DMCA Quick Buck's processing company. Again, they have a hand in turning this theft into money, and they have the ability to either make it stop or at least lower it's value to the point that it stops.

If you are truly bored and want to have some fun, DMCA notify Visa in the zone that is processing for these sites. Remember, the implication of all of these sites is that you will find these stars (and potentially this content) inside xxxpass, so there is potential that there is content used without permission / 2257 non-compliant inside the site. Therefore, when in doubt...

Have fun. Remember to send all the mail registered or by courrier requesting signature. Google has a special fax number to send this stuff to, search around on their site to get it.

Great suggestions, the sad fact is that the content owners are somehow often the last ones finding out about the violations and many are tired to act since the work and money involved to send those DMCAs, the time it takes till something happens, the problems arising with domain anonymity, bogus whois data, etc. often make them ignore those violations as long as they don't see any serious change in their stats....

The real key at this point is getting with google and yahoo. They have enormous power to remove the profitability of these ventures, making the thieving pretty much worthless. These sites exist only to snap up search engine traffic and profit from the stolen content.

I think that the owners of Quick Buck run the risk of being contributory infringers if they don't take action to reign in their "rogue affiliate" or at least stop them from making money with this stolen material.

Alex, Thanks for your time with detailing this process out, I hope to find a few other site owners like myself who is affected by this guy to help out in the process... I would haveto admit this seems like a very timely and perhaps expensive process... however, i am fully aware of the long term rewards in shutting him down... thanks again...

Blazing, actually, once you have the addresses in hand, it is exactly the same letter to each, with one change to say "you are the host" "you are the IP block operator" "you are paying these people" "you are listing these sites". Take them all in a pile, and mail them off in one shot.

The google one you can fax, and they are apparently pretty good with these things.
